Reso 6066 21-ASA-00 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 6066 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN ARCHITECTURAL AND SITE APPROVAL OF DESIGN DETAILS FOR AN APPROVED 77-ROOM HOTEL AT 20128 STEVENS CREEK BOULEVARD SECTION I: PROJECT DESCRIPTION Application No.: 21-ASA-00 Applicant: Pinn Brothers Location: 20128 Stevens Creek Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino heard an appeal of an application for Architectural and Site Approval that was approved by the Design Review Committee, as described in this Resolution; and WHEREAS, the Planning Commission finds that the design details and subsequent changes warrant its purview and therefore, the appeal was upheld and the Design Review Committee decision was denied, and WHEREAS, the subsequent design changes are beneficial and compatible with the surrounding area; 1. The proposal, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, �eneral , welfare, or convenience; 2. The proposal is consistent with the purposes of the zoning ordinance, and the General Plan. 3. The proposal will use materials that compliment neighboring structures. 4. The proposal includes landscaping that will soften the appearance of the structure. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted iii this matter, the application no. 21-ASA-00, is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application 21-ASA-00 as set forth in the Minutes of the Planning Commission Meeting of November 27, 2000, and are incorporated by reference herein. APPROVED EXHIBITS Approval is based on submitted plan sets entitled "DEVELOPMENT PLAN ADOBE INN 20128 STEVENS CREEK BOULEVARD, CUPERTINO, CA" dated 3/30/00, 11/2/00 and 9/5/00, and July 2000, and consisting of 9 pages labeled 1, A-2 through A-7, L 1 and C 1, except as may be amended by the conditions contained in this resolution. The plans shall be modified to show a ground to roof clearance of 11 and '/2 feet on the trash enclosure. 2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. [f you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 3. CIRCULATION The westerly driveway shall be signed for one-way traffic. The two-way easterly driveway shall bc signed for no-right-turn onto the westerly approach.
