OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING HEART OF THE CITY SPECIFIC PLAN DEVELOPMENT
EXCEPTIONS FOR BUILDING WITH A HEIGHT OF 45 FEET WHERE 36 FEET IS
ALLOWED AND FOR A BUILDING WITH ITS ENTRANCE ORIENTED AWAY FROM
THE PUBLIC STREET, FOR A PROPOSED TWO-STORY RETAIL/OFFICE BUILDING AT
THE MARKETPLACE SHOPPING CENTER
SECTION I: PROJECT DESCRIPTION

SECTION IL• FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for
Exception from the Heart of the City Specific Plan development standards for height and
building orientation as described in this Resolution; and
WHEREAS, the Planning Commission finds the proposed development is otherwise consistent
with the City's General Plan and the goals of the specific plan in that this commercial
development is consistent with the General Plan Land Use Map and there is adequate
development allocation for the project. The project provides Heart of the City landscape
improvements and adequate front setback;
WHEREAS, the Planning Commission finds the proposed development will not be injurious to
property or improvements in the area nor be detrimental to the public health and safety;
WHEREAS, the Planning Commission finds the proposed development has legal access to
public streets and public services are available to serve the development. The development must
contribute to any sanitary sewer capacity increase needed to service the project;
WHEREAS, the Planning Commission finds the proposed development requires exceptions
which involve the least modification of, or deviation from, the development regulations

prescribed in the plan necessary to accomplish a reasonable use of the parcel, as the height
exception is for sloping roof elements;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted
in this matter, the specific plan development exceptions herein described, are hereby
recommended for approval and
That the subconclusions upon which the findings and conditions specified in this Resolution are
based and contained in the public hearing record concerning Application 10-EXC-00, as set forth
in the Minutes of Planning Commission Meeting of November 13, 2000, and are incorporated by
reference herein.
