Reso 6020 16-U-98 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 6020 Denial OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO DENYING A USE PERMIT TO ALLOW THE DEMOLITION OF AN EXISTING DWELLING AND THE CONSTRUCTION OF FOUR DETACHED SINGLE FAMILY RESIDENCES TOTALING ABOUT 7,900 SQUARE FEET AND LOCATED AT 10216 PASADENA AVENUE SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described in Section II. of this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter; and WHEREAS, the applicant has not met the burden of proof required to support said application; and has not satisfied the following requirements: 1) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2) The project has not met the Commission directions for developing this property into a clustered single-family detached development; and 3) while the Commission may approve different standards in a planned development zoning � district, it finds the project is too massive, provides insufficient parking and landscaping, and is inadequate in design and treatment of the side and rear elevations, and is thus out of character � and scale with existing developments in the area. � NOW, THEREFORE, BE IT RESOLVED: i That after careful consideration of maps, facts, e�chibits, testimony and other evidence submitted in � this matter, the application for Use Permit is hereby denied; and That the subconclusions upon which the findings specified in this resolution are based and contained in the public hearing record concerning Application No. 16-U-98 as set forth in the � Minutes of the Planning Commission Meeting of August 9, 1999, November 8, 1999 and May R, 2000, and are incorporated by reference though fully set forth herein.
