OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN
INTERPRETATION OF THE WHEATON DRIVE FRONTAGE AS THE FRONT YARD OF A
PROPOSED RESIDENCE LOCATED AT 19777 WHEATON DRIVE IN ACCORDANCE WITH
SECTION 19.08.030 OF THE CUPERTINO MUNICIPAL CODE
SECTION I: PROJECT DESCRIPTION

SECTION II: FINDINGS
( WHEREAS, the Planning Commission of the City of Cupertino received an application for an
� interpretation, as described in this Resolution; and
� WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and

WHEREAS,the Planning Commission finds that:
� 1) Interpreting the Wheaton Drive frontage as the front yard is consistent with the existing
neighborhood context, in that the adjacent parcel at 19777 Wheaton Drive was developed with the
' front yard along Wheaton Drive instead of the legal front lot line.
2) Design relationships would be improved by this interpretation since the front yard, in that all but
one existing residence along Wheaton Drive has its front yard along Wheaton Drive.
i NOW, THEREFORE, BE IT RESOLVED:
That after cazeful consideration of exhibits, facts and testimony submitted in this matter, the
application for an interpretation is hereby recommended for approval, subject to the conditions which
are enumerated in this Resolution beginning on Page 2 thereof; and

� That the subconclusions upon which the findings and conditions specified in this resolution are based
� and contained in the public hearing record concerning Application No. 1-INT-00 as set forth in the
Minutes of the Planning Commission Meeting of April 10, 2000, and are incorporated by reference
herein.

l. APPROVED EXHIBITS
The recommendation of approval is based on the site plan titled "Residence Addition, for Ted and
Josephine Lee" for 19777 Wheaton Drive, submitted as part of this application, except as may be
amended by the conditions contained in this resolution.
PASSED AND ADOPTED this 10"' day of April, 2000, at a Regular Meeting of the Planning
Commission of the City of Cupertino, State of California, by the following roll call vote:
