Reso 5074 1-INT-99 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION 5074 OF THE PLANNING COMMISSION OF THE CITY OF CtJPERTINO APPROVING AN INTERPRETATION OF THE PACIFICA DRIVE FRONTAGE AS THE FRONT YARD OF A PROPOSED RESIDENCE LOCATED AT 20011 PACIFICA DRIVE IN ACCORDANCE WITH SECTION 19.08.Q30 OF THE CUPERTINO MUNICIPAL CODE SECTION I: PROJECT DESCRIPTION Application No.: 1-INT-99 Applicant: Keith Royster Owner: Lura Barrett Location: 20011 Pacifica Drive SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for an interpretation, as described in this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter; and WHEREAS, the Planning Commission finds that: 1) Interpreting the Pacifica Drive frontage as the front yard is consistent with the existing neighborhood context, in that the adjacent parcel at 20031 Pacifica Drive was developed with the front yard along Pacifica Drive instead of the legal front lot line. 2) Design relationships would be improved by interpreting the Pacifica Drive frontage as the front yard, in that all but one existing residence along Pacifica Drive has its front yard along Pacifica Drive. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of exhibits, facts and testimony submitted in this matter, the application for an interpretation is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application No. 1-INT-99 as set forth in the Minutes of the Planning Commission Meeting of October 25, 1999, and are incorporated by reference herein. APPROVED EXHIBITS The recommendation of approval is based on the site plan titled "New Residence, Lura Barrett" for 20011 Pacifica Drive, submitted as part of this application, except as may be amended by the conditions contained in this resolution.
