OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING AN ARCHITECTURAL AND SITE REVIEW FOR M1NOR ARCHITECTURAL
CHANGES TO THE FACADE AND WALL AT AN EXISTING GARDEN CENTER
SECTION I: PROJECT DESCRIPTION

SECTION II: FINDINGS
� WHEREAS, the Planning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the
surrounding area;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter,the application no. 8-ASA-99, is here by approved; and
� That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 8-ASA-99 as set forth in the
Minutes of the Planning Commission Meeting of July 26, 1999, and are incorporated by reference
herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
� Approval is based on submitted elevations and site plan, sheets A1, A3, and A4 dated June 15, 1999
except as may be amended by conditions of approval contained in this resolution. Sheet A2, Floor
Plan is not part of this approval.
( 2. LANDSCAPING
A precise landscaping plan shall be submitted in accordance with the Xeriscape Landscape
( Ordinance, approved by staff, and installed prior to final occupancy.

3. SCREENING
The north most 8 foot section of cyclone fencing on the northeast edge of the property shall be re-
screened to match the rest of the screening on the fence prior to the issuance of final occupancy.
4. STRUCTURE EXTERIOR COLORS
The exterior colors of the building shall match the color chips as submitted by the letter from the
applicant, dated July 15, 1999.
5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
