Reso 5054( RESOLUTION NO. 5054 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO SELECTING THE BOUNDARIES OF THE CUPERTINO VALLCO REDEVELOPMENT PROJECT � WITHIN THE REDEVELOPMENT SURVEY AREA AND APPROVING A PRELIMINARY PRELIMINARY PLAN FOR � THE REDEVELOPMENT OF THE PROJECT AREA � I WHEREAS, by Resolution No. 99-212, adopted on July 19, 1999, the City � Council of the City of Cupertino (the "City Council") designated a redevelopment survey E area (the "Redevelopment Survey Area") and found that said area required study to determine if a redevelopment pro�ect or pro�ects within said area are feasible; and 1 WHEREAS, Section 33322 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) provides that the Planning � Commission may select one or more project areas comprised of all or part of a redevelopment survey area and shall formulate a preliminary plan for the redevelopment of each selected project area; � NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF � THE CITY OF CUPERTINO AS FOLLOWS: � � Section 1. The Planning Commission hereby selects and designates as the i project area �or the Cupertino Vallco Redevelopment Project that area within the Redevelopment Survey Area shown on the "Map of the Cupertino Vallco Redevelopment Project Area," attached hereto as Exhibit A and incorporated herein by this reference, and described in the "Legal Description of the Cupertino Vallco Redevelopment Project Area Boundaries," attached hereto as Exhibit B and incorporated herein by this reference. In the event that it is necessary for clarification > purposes to make minor technical changes to the boundaries described in Exhibit B, which changes do not add or subtract area, the Planning Commission hereby finds and determines that any such minor technical change for clarification purposes does not � materially affect the boundaries selected and designated hereby for the preparation of an official redevelopment plan for the proposed project. ( Section 2. The Planning Commission hereby approves the "Preliminary Plan for the upe ino Vallco Redevelopment Project" (the "Preliminary Plan") in the form attached hereto as Exhibit C and incorporated herein by this reference. Section 3. INTRODUCTION This Preliminary Plan for the Cupertino Vallco Redevelopment Project ("Project") has been prepared to fulfill the requirements of Section 33324 of the California Community Redevelopment Law (Health and Safety Code Section 33300 ef seq.). This Preliminary Plan consists of text, a map, and legal description of the project area for the proposed Cupertino Vallco Redevelopment Project Area ("Project Area"). The primary purpose of this Preliminary Plan is to serve as the basis for the preparation of the Redevelopment Plan for the Project. II. DESCRIPTION OF THE BOUNDARIES OF THE PROJECT AREA The boundaries of the Project Area are shown on Exhibit A, Project Area Map, and described in Exhibit B, Project Area Legal Description. III. GENERAL STATEMENT OF THE LAND USES, LAYOUT OF PRINCIPAL STREETS, POPULATION DENSITIES, AND BUILDING INTENSITIES AND STANDARDS A. Land Uses � It is proposed that as the basis for redevelopment in the Project Area; the permitted land uses in the Project Area be as described and defined in Section II of the Land Use Element of the City's General Plan as it currently exists and as it may be I amended from time to time. The land uses currently permitted in the Project Area under the General Plan include: mixed-use commercial, office, industrial and /or hotel facilities. Layout of Principal Streets As a basis for the redevelopment of the Project Area, it is proposed that in general, the layout of principal streets be as shown on Exhibit A, the Project Area Map. Existing streets within the Project Area may be closed, widened or otherwise modified, and additional streets may be created as necessary for proper pedestrian and vehicular circulation consistent with the City's General Plan as it currently exists and as it may be amended from time to time by the City. C. Population Densities It is proposed that as a basis for the redevelopment of the Project Area, the standards for population densities should be consistent with the residential densities established by the City's General Plan as it currently exists and as it may be amended from time to time by the City. D. Building Intensities � As a basis for the redevelopment of the Project Area, it is proposed that building intensities be controlled by procedures and criteria established in the City's General Plan and Municipal Code as the same currently exist and as they may be amended from time to time by the City. Such criteria may include limits on (1) the percentage of ground covered by buildings (land coverage); (2) the ratio of the total floor area for all stories of the buildings to areas of the building sites; and (3) the heights of buildings and development standards. The land coverages, sizes and location of buildable areas should be limited as feasible to provide adequate open space. As a basis for the redevelopment of the Project Area, building standards shall conform to the building requirements of applicable state statutes and local codes and i ordinances and shall be consistent with the City's General Plan as it currently exists and as it may be amended from time to time by the City. IV. ATTAINMENT OF THE PURPOSES OF THE CALIFORNIA COMMUNITY � REDEVELOPMENT LAW . ' Certain goals and objectives have been identified in connection with the Project, the accomplishment of which will attain the purposes of the California Community Redevelopment Law. In general, the goals and objectives of the Project are as follows: � i 1. The establishment, by effective use of the redevelopment process, of a planning and implementation framework that will ensure the proper, � long-term redevelopment of the Project Area. � ' 2. The elimination and prevention of the spread of blight and deterioration, , and the conservation and rehabilitation of the Project Area in accordance Keyser Marston Associates, Inc. 11413.002\001-016.doc Page 2 � with the City's General Plan, specific plans, and local codes and i ordinances. 3. The planning, design, and redevelopment of underdeveloped or poorly developed areas that are underutilized or improperly utilized. 4. The strengthening of the economic base of the Project Area by redevelopment and rehabilitation of structures and installation of needed , site improvements. 5. The promotion of new private sector investment within the Project Area to facilitate the revitalization of an important commercial center. 6. The elimination or amelioration of certain environmental deficiencies, such as insufficient off- and on-street parking, and other public improvements, facilities and utilities deficiencies adversely affecting the Project Area. 7. The creation and development of local job opportunities and the preservation of the existing employment base. 8. The provision, by rehabilitation or new construction, of improved housing for individuals and/or families of low to moderate income within the City limits. 9. The provision of assistance to existing building owners in financing renovations needed to bring their buildings up to current codes and standards. Redevelopment of the Project Area pursuant to this Preliminary Plan and the above goals and objectives will attain the purposes of the California Community Redevelopment Law through: (1) the elimination of blighting influences; (2) the re- planning, redesign and/or redevelopment of areas which are stagnant or improperly utilized, and which would not be accomplished by private enterprise acting alone without public participation and assistance; (3) the protection and promotion of sound development and redevelopment of blighted areas and the general welfare of citizens of the City of Cupertino by remedying such injurious conditions through the employment of appropriate means; and (4) the installation of new or replacement of existing public improvements, facilities, and utilities in areas that are currently inadequately served with regard to such improvements, facilities, and utilities. V. CONFORMANCE TO THE GENERAL PLAN OF THE CITY OF CUPERTINO This Preliminary Plan is consistent with the City's General Plan because it proposes a pattern of elements of the City's general land uses, circulation, and public facilities that are to be guided by the General Plan. Further, the proposed redevelopment of the Keyser Marston Associates, Inc. 11413.002\001-016.doc Page 3 Project Area as described in this Preliminary Plan will help the City of Cupertino to achieve the goals and objectives of the City's General Plan. These goals and objectives include: � ■ Using redevelopment as a strategy to attract private and public investment in undeveloped, underutilized or blighted areas; ■ Attracting new businesses to the area and enhancing the vitality of existing businesses to better serve the surrounding neighborhoods; ■ Improving the physical conditions and quality of the declining commercial area; ■ Preserving and increasing the supply of affordable housing citywide; ■ Maki�ng more efficient use of existing public infrastructure and services, and providing improvements to address inadequacies and constraints; ■ Creating additional employment opportunities by attracting new businesses; and ■ Providing a more favorable relationship between jobs and housing opportunities through the creation of jobs near existing residential areas. VI. GENERAL IMPACT OF THE PROJECT UPON RESIDENTS THEREOF AND UPON SURROUNDING NEIGHBORHOODS The impact of the Project upon residents in surrounding neighborhoods, as well as upon business owners and tenants within and surrounding the Project Area, would generally include improved access, enhanced shopping opportunities, increased employment, expanded economic development and upgraded public infrastructure. The environmental impacts of the Project will be considered in detail by the Redevelopment Agency in the Environmental Impact Report which will be circulated in draft form for public comment prior to the approval of the Redevelopment Plan by the City Council.
