OF THE PLANNING COMMISSION AND CITY OF CUPERTINO APPROVING A SIGN
EXCEPTION TO CONSTRUCT A MONUMENT SIGN AT AN EXISTING RESTAURANT
LOCATED AT 10100 DEANZA BOULEVARD.
SECTION 1: PROJECT DESCRIPTION

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
sign exception as described in this Resolution; and
WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and
has met the following findings for a Sign Exception as required in Section 17.44.040 of the
Cupertino Municipal Code:
, 1. That the literal enforcement of the provisions of this ordinance will result in restrictions
inconsistent with the spirit and intent of this ordinance;
2. That the granting of the exception will not result in a condition which is materially
detrimental to the public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of the
prescribed regulations and the minimum variance that will accomplish the purpose.
NOW, THEREFORE BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other evidence submitted in this
matter,the application for exception is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are
based and contained in the Public Hearing record concerning Application 5-EXC-99, as set forth
in the Minutes of the Planning Commission Meeting of June 14, 1999, and are incorporated by
reference herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT
DEPARTMENT
APPROVED EXHIBITS
The approval is based on Exhibit A titled"Armadillo Willy's 10100 DeAnza Boulevard,
, Cupertino, California" and dated May 20, 1998, Exhibit B titled "Site Plan Detail" and dated
May 20, 1998, except as may be amended by the Conditions contained in this Resolution.
HEIGHT
The height of the sign shall not exceed eight feet from the top of the curb to be installed by the
applicant on DeAnza Boulevard.
LOCATION
The sign shall be installed a minimum of one-foot from the public right-of-way.
DESIGN
The color of the red and yellow"Real Texas BBQ"banner shall be changed to gold with white
lettering.
NUMBER OF SIGNS
The monument sign is approved subject to removal of one painted wall sign. A maximum of one
wall sign and one monument sign or two wall signs without a monument sign shall be allowed at
the restaurant site.

Commission of the City of Cupertino, State of California, by the following roll call vote:
