Reso 5041 32-ASA-98 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 5041 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING ARCHITECTURAL REVIEW OF A PROPOSED REMODEL OF A FA�ADE OF AN EXISTING COMMERCIAL BUILDING � SECTION I: PROJECT DESCRIPTION � Application No.: 32-ASA-98 Applicant: Keith Royster, AIA Property Owner: Frank Helmond Location: Woodworks Furniture: North side of Stevens Creek Boulevard between Blaney Avenue and Portal Avenue SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for � architectural modifications; and WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the specific development standards (except parking), and the Heart of the City Specific Plan; and WHEREAS, the 35-year furniture tenant has been able to prove that additional parking beyond the existing parking is not necessary to meet their demand. Future changes in use will trigger consistency with parking regulations, additional landscaping and lighting in the rear parking lot. � NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the building modifications described above are hereby approved subject to the conditions which are enumerated in this Resolution; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 32-ASA-98, as set forth in the Minutes of the Planning Commission Meeting of May 24, 1999, and are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Except as modified by other conditions in this resolution, the following plans are approved: Sheet l, Site Plan - Existing, Sheet 2, Site Plan - Proposed Future Phase, Sheet 3, Front Elevation and Plan, and Sheet 4, Left and Front Elevations, dated November 17, 1998. Resolution No. 5041 32-ASA-98 May 24, 1999 Page -2- ' 2. PARKING A phased parking plan is approved. Phase I shall include the parking improvements shown on Page l, which shall be completed simultaneous with the building fa�ade improvements. The 15' "New Landscape" strip on the north portion of the lot is not � required and part of this approval. Any future use other than a furniture store requires the completion of the Phase II Parking Plan (Page 2) that meets the required parking stall dimensions and aisle widths, and maximizes the number of potential parking stalls. � 3. DEED RESTRICTION A deed restriction shall be recorded along with the fa�ade improvements. The specific text shall be approved by the City Attorney. The deed restriction shall require that any future use other than a furniture store shall trigger the parking lot paving, landscape and ► lighting improvements and reciprocal access for the entire rear parking lot as conceptually shown on plan Page 2. 4. LIGHTING Lighting shall be approved and installed for the Phase I parking lot. They shall be installed with the fa�ade improvements. Side lighting shall be installed on the building. � The specific light standards and a lighting contour plan shall be approved by staff and reviewed by the County Sheriff's Department. � � 5. SIGNS The signs presented on Sheets 3 and 4 are not approved. 6.
