Reso 5021 1-EXC-99 CITY OF CUPERTINO 10300 Torre Avenue i Cupertino, California 95014 RESOLUTION NO. 5021 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A SIGN EXCEPTION TO ALLOW THREE GROUND SIGNS WHEN TWO IS THE MAXIMUM, 108 SQUARE FEET OF GROUND SIGN AREA WHEN 100 SQUARE FEET IS THE MAXIMUM, AND THREE WALL SIGNS WHEN ONE IS THE MAXIMUM AT 10795 S. BLANEY AVENUE AND 20075 BOLLINGER ROAD SECTION I: PROJECT DESCRIPTION Application No.: 1-EXC-99 Applicant: Cal-Neon Signs (Walgreens) Property Owner: Intrinsic Cupertino, LLC Location: 10795 S. Blaney Avenue and 20075 Bollinger Road SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a sign exception, as described in this Resolution; and WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and has met the following findings for a Sign Exception as required in Section 17.44.040 of the Cupertino Municipal Code: 1. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent with the spirit and intent of this ordinance; 2. That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or welfare; and 3. That the exception to be granted is one that will require the least modification of the prescribed regulations and the minimum variance that will accomplish the purpose. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the sign exception, file no. 1-EXC-99, is hereby approved; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application 1-EXC-99 as set forth in the Minutes of the Planning Commission Meeting of February 8 and March 8, 1999, and are incorporated by reference herein. Approved Exhibits The approval is based on Exhibits titled "Blaney @ Bollinger, Cupertino, Calif." Dated 4/9/8, 4/10/98 or 2/9/99 and consisting of 5 sheets labeled 1 through 5, except as may be amended by the Conditions contained in this Resolution. 2. Maximum Wall Sign Height The"Walgreens"wall signs shall be no more than 24" in height as provided in the Cupertino Sign Code. 3. Sign Program The approved exhibit reference in Condition #1 represents a sign program. For the three lots depicted on sheet 5 of 5, the individual ground signs may identify individual tenants located on any of the three future lots. The covenants, conditions and restrictions shall provide for common usage of the approved ground signs and no additional ground sign or expansion of sign area shall be permitted unless the subject sign program is amended by City approval. 4. Timing of Illumination of Signs The illumination of wall and monument signs shall be turned off at close of business.
