BACKGROUND: The applicant, representing Verizon Wireless, proposes to remove an
existing 58-foot tall cable television lattice tower and construct a personal wireless service

facility consisting of 6 panel antennas mounted at a height of 64-feet on a 70-foot tall monopine
and an associated base equipment enclosure. The new wireless antennas cannot be mounted on
the existing television lattice tower due to its structural deficiencies and insufficient height. The
proposed new facility is designed for antenna collocation and a separate application for a
collocated AT&T personal wireless service facility will be presented to the Planning
Commission as a separate item.
The proposed Verizon Wireless facility is located to the rear of 22475 Rancho Deep Cliff Drive
near the entrance gate of this planned residential development. The aUutting land uses to this
project are single-family residences to the east, south and west, and apartment buildings to the
north.
The project is sited on common open space area owned by the Deep Cliff Homeowners
Association (HOA). The HOA stated that the current lack of wireless phone coverage presents a
genuine public safety concern for residents in Rancho Deep Cliff, as well as the surrounding
neighborhood. Existing & proposed wireless coverage is depicted on Attachment 2.

The applicant proposes to remove an existing 58-foot tall cable television lattice tower on the
project site and install a 70-foot tall stealth monopine that will support antennas for two personal
wireless service facilities. The lattice tower with antenna attachments is highly visible from
Stevens Canyon Road and other neighboring streets. The monopine is sited within a grove of
other tall pine trees to screen the lower portion of the monopine from public street and
residential views. See photosimulations (Attachment 3). Other design requirements, such as,
faux bark, painting of mast & antennas, mixture of brown & green needles and needle socks on
the panel antennas have been added to the Architectural and Site Approval to minimize any
potential visual obtrusiveness of the structure.
At grade views of the monopine and equipment enclosure will be screened by fencing, either
redwood fencing or masonry wall to match the existing wall, as depicted in the plan set. From
the apartment side, the mast will be screened with new trees, California Wax Myrtles and the
faux bark. Any disturbed ground cover areas will be replanted.
Noise
The personal wireless service facility operates 24 hours per day. The cabinet equipment is
expected to meet City noise standards (i.e. 55 dBA at nighttime: 8:00 p.m. to 7:00 a.m.) with the
mitigation proposed by the noise consultant (Attachment 4). The noise consultant's
recommendation is a 2 and 1 /2 foot tall wall extension between the equipment and monopine,
which is depicted on the plan set. The project contribution to the interior noise level of the
adjacent residence, 42 dBA, is below the City requirement of 45 dBA.
Geotedmical Considerations
The project vicinity is located in one of the City's Geologic Hazard Zones characterized by
potential surface fault rupture, and very strong to violent ground shaking. A private
geotechnical report was prepared by Beacon Geotechnical, Inc. and reviewed by the City
Geologist, Cotton, Shires and Associates, Inc. (Attachments 5, 6). The City Geologist supports
the project provided that the final foundation system is designed to resist both wind and seismic
forces. The final foundation design will be reviewed and approved by the City Geologist prior to
issuance of any building permits. A condition addressing the Cit� Geologist's comments has
Ueen added to the use permit.
Radio Frequency (RF) Energy Analysis
A RF report was prepared by Hammett & Edison, Inc. The report estimated that the RF energy
exposures at the ground level and the second floor of the nearest residence are well within the
Federal safety standards for RF exposure. The safety standards for cellular and 700 MHz
wireless services are 0.58 and 0.47 mW/cm The project ground level exposure was calculated
to be 0.0068 mW/cm , which is 1.3% of the applicable public exposure limit. The second floor
calculated, cumulative (Verizon plus the AT&T collocated facilities) exposure for the nearest
residences is expected to be 3.9% of the applicable public exposure limit (Attachment �.
Tree Removal
The applicant is proposing to remove two trees: a 45-inch diameter Monterey Pine and a 9-inch
diameter Chinese Pistache that are within the respective footprints of the monopine and
equipment enclosure. The Monterey Pine is infested with Japanese Pine Beetle and the Chinese

Pistache is healthy. Five 15-gallon California Wax Myrtles are proposed as replacements and
screening for the monopine base.
Staff has identified another 10-inch diameter Chinese Pistache that may need to be removed. A
planned 2-foot wide utility trench crosses its root zone, even though the proposed plans intend
to preserve this tree. In the event that this tree must be removed or does not survive the
construction activities, the applicant is required to replace it with a 36" box Pistache planted in
the general vicinity. A final planting report prepared by a professional arborist will required
prior to final sign-off of the project.
Alternatives Analysis
The applicant evaluated seven other potential cell sites in the vicinity of the project site. These
sites are depicted on an aerial map (Attachment 8). The candidate sites are described below
followed by the applicant's analysis:

In summary, the extensive tree cover and hilly terrain of the area limit the RF coverage of the
various alternative sites. Rancho Deep Cliff HOA is primarily interested in providing wireless
communications coverage for its residents and that is why it has offered its property to the
wireless carriers. The Rancho Deep Cliff property has been identified by the applicant as being
the best location to provide coverage to Ranch Deep Cliff and the surrounding areas.

Heiglit Exception
The applicant is requesting approval for a height exception to allow the antennas to be mounted
at a height of 64 feet when the ordinance maximum height is 55 feet. Please note that the 55-foot
maximum height limit applies to the mast and antennas of the personal wireless service facility.
The camouflaging branches above the antennas are not subject to the height limit, nor is a height
exception required for the branching, which is intended to give the monopine a more natural
appearance.
The Planning Cominission may grant a height exception upon making the following findings.
Staff comments follow in italics:
1) The literal enforcement of the provisions of this chapter will results in restrictions
inconsistent with the spirit and intent of this chapter.
Tlze purpose of tlie ordinance is to facilitate tl�e development of a znireless communications
infrastructure, z��hile protecting tlle healtli, safety, z��elfare and aestlietic concerns of the public. One of
the design criteria of tlzis ordinance is to seek opportunities for collocation of aerials on ea:isting masts
and tozners u�liere visual intrusiveness is reduced. Tlie height exception is needed because of the lzeight
of t12e surrounding trees and tlze design of t11e monopine, u�hich allou�s the collocation of another
u�ireless carrier's antennas on the monopine. Staff believes the collocated antennas can be adequately
screened, forgoing tl2e need for another carrier's monopole in t)Te neiglzborhood.
2) The granting of an exception will not result in a condition that will be detrimental or
injurious to property or improvements in the vicinity and will not be materially detrimental
to the public health, safety or welfare.

levels zc�ill also be u�ithin City noise standards.
3) That the exception to be granted will not result in a hazardous condition for pedestrian and
vehicular traffic.
Tlie height exception does not obstruct any pedestrian or velzicular travel zc�ays.
The City's Wireless Facilities Master Plan encourages collocation of wireless facilities when the
collocation design is expected to be less visually intrusive than separate monopoles. Staff
supports collocation at this project site and the City has approved collocatable wireless facilities
at Results Way, Memorial Park and the City Service Center.
Setback Variance
The Wireless Communications Ordinance requires the mast or tower of a personal wireless
service facility to be setback 75 feet from the property line of an abutting residentially zoned
property. The applicant is requesting a variance approval to allow the mast to be setback eight
(8) feet from the property line. Prior to changes in the Wireless Communications Facilities
Ordinance, the Planning Commission approved a setback variance to allow a personal wireless
service facility to locate on an existing PG&E lattice tower that was less than 75 feet from
residences near Homestead & Stelling Roads.

To grant the variance the Planning Commission must make five findings as followed. Staff
comments are in italics:
1) There are special circumstances applicable to the property that do not apply generally to
property in the same district.
According to the applicant(s), tllis is tl�e only analyzed cell site tliat meets t11e functional RF coverage
requirements for both u�ireless carriers: Verizon Wireless and AT�T. Tlze site lias good line-of-sight
doum Stez�ens Canyon Rorzd/Foothill Boulez�ard and all properties dozcroslope to Stevens Creek zc�ithout
tlze obstruction of trees and hilly terrain that made the seven alternative sites nonviable for tlze
applicant. In addition tlze location is zc�ell-screened by sliorter trees, zc�itli reasonable access to needed
utilities and has a zc�illing property lessor. In addition, t)ze proposed cell site location on the project
J�roperty z��ill result in tlze least amount of visual impacts to tl�e surround neighborlTOOd.
2) The special circumstances applicable to the property deprive the property of privileges
enjoyed by other property in the vicinity and under identical zoning classification.
T1�e common o�en space areas of R1Gzoned developments are commonly dez�eloped as landscaped
pedestrian u�alkzc�ays or recreational facilities. Ty�e project site is a narrozc� portion o tlze common
interest area situated betzc�een t11e rear of a single family residence and tlze rear of an apartment
building. The area is not conduciz�e to the dez�elopment of landscaped pedestrian z��alkzc�ays or
recreational facilities.
3) The issuance of the variance will not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zoning in which such property is
situated.
Tl�e only otl�er vicinity properties that are permitted by zoning to host a personal zvireless service
facility are: RHS-zoned properties, common open space areas of residential developments, parks, Deep
Cliff Golf Course, Stevens Creek Plaza Shopping Center and Monta Vista Higlz Sclzool. All of tlZese
other alternative sites zc�ere deemed infeasible by tlie applicant. Tlzus, the granting of tliis variance does
not constitute rz grant of special privileges. Tlie existing lattice tou�er is in tl�e same location zc�itli a
similar setback to the property line.
4) The variance is not being issued for the purpose of allowing a use that is not otherwise
expressly authorized by the zone regulation governing the parcel of the property.
The Wireless Communications Facilities Ordinance expressly allou�s t)ze construction of personal
zc�ireless service facilities in commonly-oumed areas of residential dez�elopments zc�itlT a use permit
reviezc�.
5) The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, and
general welfare, or convenience, and to secure the purpose of the title.

geologic impacts. RF energy exposures are estimated to be zc�ell-zc�itlTin federal safety standards. TITe

Public Notifccation and TICC/Public Comments
The applicant held a meeting for the HOA on December 9, 2010. Public hearing notices were
mailed to a 1,000-foot property owner radius around Ranch Deep Cliff.
As of October 20, 2011, staff has not received any additional public comments other than ones
described below. The project was reviewed by the Technology, Information and
Communications Commissioners (TICC - see Attachment 9). In addition, the City has received a
letter from the Rancho Deep Cliff HOA president, stating an 86% support from the HOA
residents (Attachment 10).
The TIC Commissioners were supportive of the project, noting that the 2009 TICC survey
indicated that this area was particularly poor for wireless coverage; the monopine would replace
an existing, highly visible lattice tower and the project had the proactive support of the HOA.
TICC stated that cabinet equipment noise needed to be studied and abated (Please see Noise
discussion aUove).
The Rancho Deep Cliff HOA has requested in its letter that three conditions be added to the City
approvals of this project (Staff comments in italics):
1) Lower the grade of the Verizon equipment enclosure to the same level as the sidewalk in the
common area adjacent to 22475 Rancho Deep Cliff Drive. The enclosure shall be fenced with
a wooden fence (Request lias been incorporated in tl�e ASA approz�all�esolution).
2) The applicant shall conduct post-construction noise monitoring at the project site and five
nearby residences (22395, 22415, 22435, 22455 and 22456 Rancho Deep Cliff Drive) to ensure
that equipment complies with all City noise standards. Applicant will bear the cost of
mitigating any excessive noise generated by the equipment (Request l�zs been incorporated in the
Use Per��zit approval resolution. Testing sliould be delayed until after botlz z��ireless facilities are
operational so tlie cu»iulative noise can be studied).
3) The applicant shall conduct post-construction RF energy monitoring at the project site and
five nearby residences (22395, 22415, 22435, 22455 and 22456 Rancho Deep Cliff Drive) to
ensure that the facility does not exceed the estimated RF exposure levels reported in the
Hammett and Edison, Inc. report of June 17, 2011. If the estimated exposure levels are
exceeded, tlze applicant will modify the equipment to meet those reported estimated
exposures (Request 1Tas been incorporated in tlze Use Permit approval resolution. Testing should be
delayed until after both zc�ireless facilities are operational so tlze cumulatiz�e RF energy exposure can be
studied. Please note that tl�e Hammett � Edison, Inc. report estimates RF energy exposures that are
far belou� Federal safety limits. The City cannot enforce a RF exposure level tliat is more stringent

WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use
Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property
or improvements in the vicinity, and will not be detrimental to the public health, safety,
general welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan, the Wireless Facilities Master Plan, the Wireless
Communications Facilities Ordinance and the purpose of this title.
3) That the operation of the facility will comply with federal safety standards for radio
frequency energy emissions.

2. USE PERMIT ALLOWANCE
The applicant is authorize to apply for building permits to demolish the existing television
lattice tower and construct a personal wireless service facility that includes a 70-foot tall
monopine and associated equipment enclosure.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount
of such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later challenging such
exactions.
4. COLOCATION OF ANTENNAE
The monopine shall be structurally designed to accommodate the collocation of additional
antennae from other wireless carriers. The co-location agreement shall be at market rates
with reasonable compensation to the mast owner.
5. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period
of 18 months, said aerial and associated facilities shall be removed. The applicant shall bear
the entire cost of demolition.
6. EXPIRATION DATE
This use permit shall expire ten (10) years after the effective date of the permit. The applicant
may apply for a renewal of the use permit at which time the Planning Commission may
review the state of wireless communication technologies, camouflage techniques and
maintenance to determine if the visual impact of the aerial facility can be reduced.

7. POST-CONSTRUCTION TESTING OF RADIO FREQUENCY (RF LEVELS
The applicant shall monitor and report on cumulative RF energy emissions and compare
exposures to the Federal safety standards in mW/cm when both personal wireless service
facilities are operational. If the operation of the second wireless facility is delayed by more
than six months from the operation of the applicant's wireless facility, then the applicant shall
report on only his facility. Emissions testing shall include measurements at sites next to
22395, 22415, 22435, 22455 and 22456 Rancho Deep Cliff Drive and the second story of the
adjacent apartment building. The results of these tests will be made available to the
Planning Department and Rancho Deep Cliff Homeowners' Association for review. The City
reserves the right to perform code enforcement actions and/ or revoke this use permit if the
results show RF exposure levels in excess of the applicable federal standards.
8. POST-CONSTRUCTION TESTING OF NOISE LEVELS
The applicant shall monitor and report on cumulative noise levels and compare them to City
daytime and nighttime noise standards when both personal wireless service facilities are
operational. If the operation of the second wireless facility is delayed by more than six
months from the operation of the applicant's wireless facility, then the applicant shall report
on only his facility. Noise testing shall include measurements at sites next to 22395, 22415,
22435, 22455 and 22456 Rancho Deep Cliff Drive and the property line abutting the adjacent
apartment building. The results of these tests will be made available to the Planning
Department and Rancho Deep Cliff Homeowners' Association for review. The City reserves
the right to perform code enforcement actions and require noise mitigations if the results
show noise levels in excess of the applicable city standards.
9. ADDITIONAL GEOTECHNICAL REVIEW
At the building permit stage, the applicant shall comply with the geotechnical
recommendations of the City Geologist, Cotton, Shires and Associates, in its letter dated May
19, 2011.
10. CONSTRUCTION MANAGEMENT PLAN
Applicant shall submit a construction management plan sheet with the building permit
submittal.

2. The proposal is consistent with the purposes of Chapter 19.134, Architectural and Site Review, of the
Cupertino Municipal Code, the General Plan, the wireless facilities master plan, zoning ordinances,
applicable planned development permit, conditional use permits, variances, subdivision maps or
other entitlements to use which regulate the subject property including, but not limited to, adherence
to the following specific criteria:
a) Abrupt changes in scale have been avoided. The new monopine has been sited in an area with
existing tall trees.
b) Design harmony between the new monopine and existing trees has been preserved and the
materials, textures and colors of the new monopine harmonize with adjacent landscaping and
preserve the future character of the neighborhood and purposes of the zone in which it is
situated. The location, height and materials of walls, fencing, hedges and screen planting
harmonize with adjacent development. Unsightly utility installations have been concealed.
Ground cover or various types of pavements have been used to prevent dust and erosion, and
the unnecessary destruction of existing healthy trees have been avoided to the extent practical.
c) This new development, abutting an existing residential development, has been designed to
protect residents from noise, traffic, light and visually intrusive effects by use of buffering,
setbacks, landscaping, fences and other appropriate design measures.

2. ACCURACY OF PROTECT PLANS
The applicant/property owner is responsible to verify all pertinent property data including but not
lunited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
3. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file nos. U-2011-07, EXC-2011-07, V-2011-01 and TR-2011-
12 shall be applicable to this approval.
4. DEVELOPMENT APPROVAL
Architectural and Site Approval is granted for the architectural design and site planning for a
personal wireless service facility consisting of six panel antennas mounted on a 70-foot tall
monopine and associated equipment enclosure.
The Planning Commission shall review amendments to the project considered major by the Director
of Community Development.
5. MONOPINE APPEARANCE AND MAINTENANCE
The applicant shall construct a monopine that achieves a tree-like appearance and satisfactorily
camouflages exposed equipment by implementing the design criteria below:
a) Use a sufficient number of artificial branches of sufficient lengths to obscure the appearance of the
panel antennae and any associated mounting framework.
b) The top portion of the monopine shall have branches of varying lengths to give the tree pole a
conical form.
c) The faux needles shall present a mottled green coloration with a color mixture composed of 20%
brown needles to 80 % green needles
d) The entire monopine mast shall be clad with a faux bark material.
e) Panel antennae mounted away from the mast shall be painted green to match the foliage of the
monopine. The antennae mounting hardware and RRU's shall also be painted green to match the
foliage of the monopine.
� All panel antennae shall have needle covers to blend with the foliage of the monopine.
g) Cabling shall be internalized within the mast of the personal wireless service facility.

The building permit shall be reviewed and approved to the satisfaction of the Community
Development Director to ensure the above condition is met. The applicant shall perform regular
maintenance of the monopine to maintain its appearance and obscure the panel antennae from public
view.
6. EQUIPMENT ENCLOSURE
The grade of tlie equipment enclosure shall be lowered to the same level as the walkway in the
common area adjacent to 22475 Rancho Deep Cliff Drive and screened on the south and east sides by
a redwood fence. Any new masonry walls shall be textured and colored to match the existing
masonry walls. The final enclosure design, wall treatment/color and screening strategy shall be
reviewed and approved by the Director of Community Development prior to issuance of building
permits.
7. TREE REPLACEMENT & RELANDSCAPING
The removed trees are to be replaced with five (5) 15 gallon California Wax Myrtles planted between
the monopine and the apartment complex. A 36-inch box Chinese Pistache shall be planted in the
general vicinity if the 10-inch diameter Chinese Pistache is removed. Ground cover areas that are
disturbed by construction activities shall also be restored by the applicant. Final tree locations shall
be reviewed and approved by the Director of Community Development prior to issuance of building
permits. Applicant shall provide a letter from a landscape architect, certifying that the newly planted
trees and other replaced landscaping are in good health and the irrigation system is operating
properly to maintain the vegetation.

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
Variance, as described on Section I. of this Resolution; and
WHEREAS, the necessary notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Planning Commission has held one or more Public Hearings
on this matter; and
WHEREAS, the Planning Commission finds that the applicant has met the burden of proof
required to support this application, and has met the following findings in order to grant the
variance:
1) There are special circumstances applicable to the property that do not apply generally to
property in the same district, in that according to the applicant(s), this is the only analyzed
cell site that meets the functional RF coverage requirements for both wireless carriers:
Verizon Wireless and AT&T. The site has good line-of-sight down Stevens Canyon
Road/ Foothill Boulevard and all properties downslope to Stevens Creek without the
obstruction of trees and hilly terrain that made the seven alternative sites nonviable for the
applicant. In addition the location is well-screened by shorter trees, with reasonable access to
needed utilities and has a willing property lessor. In addition, the proposed cell site location
on the project property will result in the least amount of visual impacts to the surrounding
neighborhood.
2) The special circumstances applicable to the property deprive the property of privileges
enjoyed by other property in the vicinity and under identical zoning classification. T'he
common open space areas of R1C-zoned developments are commonly developed as
landscaped pedestrian walkways or recreational facilities. The project site is a narrow
portion of the common-interest area situated between the rear of a single-family residence
and the rear of an apartment building. The area is not conducive to the development of
landscaped pedestrian walkways or recreational facilities.

3) The issuance of the variance will not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zoning in which such property is
situated. The only other vicinity properties that are permitted by zoning to host a personal
wireless service facility are: RHS-zoned properties, common open space areas of residential
developments, parks, Deep Cliff Golf Course, Stevens Creek Plaza Shopping Center and
Monta Vista High School. All of these other alternative sites were deemed infeasible by the
applicant. Thus, the granting of this variance does not constitute a grant of special privileges.
The existing lattice tower is in the same location with a similar setback to the property line.
4) The variance is not being issued for the purpose of allowing a use that is not otherwise
expressly authorized by the zone regulation governing the parcel of the property. The
Wireless Communications Facilities Ordinance expressly allows the construction of personal
wireless service facilities in commonly-owned areas of residential developments with a use
permit review.
5) The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, and
general welfare, or convenience, and to secure the purpose of the title. The facility has been
designed to blend in with the residential environment and will mitigate noise and geologic
�impacts. RF energy exposures are estimated to be well-within federal safety standards. The
availability of wireless communications coverage to this area will improve public
convenience and safety.
NOW, THEREFORE, BE IT RESOLVED:

FACILITATE THE CONSTRUCTION OF A PERSONAL WIRELESS SERVICE FACILITY NEXT TO 22475

SECTION I: PROTECT DESCRIPTION

Location: Common area next to 22475 Rancho Deep Cliff Drive
SECTION II: FINDINGS FOR TREE REMOVAL
WHEREAS, the Plaru�ing Commission of the City of Cupertino received an application for tree removal,
as described in Section I of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Planning Commission has held at least one public hearing on this
matter; and
WHEREAS, the Planning Commission finds the following with regard to this application:
That the tree or trees are irreversibly diseased, are in danger of falling, can cause potential damage to
existing or proposed essential structures, or interferes with private on-site utility services and cannot be
controlled or remedied through reasonable relocation or modification of the structure or utility services;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of the maps, facts, exhibits, testimony and other evidence submitted in
this matter, subject to the conditions which are enumerated in this Resolution beginning on page 2
thereof,:
The application for a Tree Removal Permit, Application no. TR-2011-12, is hereby approved, and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application no. TR-2011-12 as set forth in the
Minutes of Planning Commission Meeting of October 25, 2011, and are incorporated by reference as
though fully set forth herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED REMOVALS
Approval is based on Exhibits titled: "verizonwireless/West Cupertino/Adjacent to 22475
Rancho Deep Cliff Drive/Cupertino, CA 95014 SITE No.193868" prepared by L.D. Strobel
Co. Inc./Design/Construction dated 06/03/11 and consisting of eight sheets labeled T-1, C-1
(2 sheets), A-1, A-1.1, A-2, A-3 and L-1, except as may be amended by the conditions
contained in this resolution.

2. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file no. U-2011-07, ASA-2011-09, EXC-2011-07 and V-2011-01
shall be applicable to this approval.
3. REQUIRED TREE REPLACEMENTS
The removed trees are to be replaced with five (5)15 gallon California Wax Myrtles planted between
the monopine and the apartment complex. A 36-inch box Chinese Pistache shall be planted in the
general vicinity if the 10-inch diameter Chinese Pistache is removed. Ground cover areas that are
disturbed by construction activities shall also be restored by the applicant. Final tree locations shall
be reviewed and approved by the Director of Community Development prior to issuance of building
permits. Applicant shall provide a letter from a landscape architect,,certifying that the newly planted
trees and other replaced landscaping are in good health and the irrigation system is operating
properly to maintain the vegetation.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest
within this 90-day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.

BACKGROUND:
The applicant, representing AT&T, proposes to construct a personal wireless service facility,
consisting of 12 panel antennas mounted at a height of 54-feet on a proposed 70-foot tall
monopine proposed by Verizon Wireless, and an associated base equipment enclosure. The

Verizon monopine is designed for antenna collocation and the Verizon applications will be
reviewed by the Planning Commission as a separate item.
The proposed AT&T personal wireless service facility is located to the rear of 22475 Rancho
Deep Cliff Drive behind the residence. The abutting land uses to this project are single-family
residences to the east, south and west, and apartment buildings to the north.
The project is sited on common-interest area property owned by the Deep Cliff Homeowners
Association (HOA) zoned P(R1C) (Planned Single-Family Residential Cluster). The HOA state
that the current lack of wireless phone coverage presents a genuine public safety concern for
residents in Rancho Deep Cliff and the surrounding neighborhood. Existing & proposed
wireless coverage is depicted on Attachment 2.

DISCUSSION:
Visibility and Screening of Wireless Facility
The project will collocate 12 panel antennas on a proposed Verizon monopine at a height of 54
feet. The monopine is sited within a grove of other tall pine trees. See photosimulations
(Attachment 3).
The antennas and the mounting hardware will be painted to match the monopine and needle
socks will be placed over the panel antennas. The branches will be extended sufficiently to
obscure the antennas. These design requirements have been added to the Architectural and Site
Approval to minimize any potential visual intrusiveness of the structure.
At-grade views of the equipment enclosure will be screened by redwood fencing on all sides.
Disturbed ground cover areas will be replanted.
Noise
The personal wireless service facility operates 24 hours per day. The cabinet equipment is
expected to meet City exterior noise standards (i.e. 55 dBA at nighttime: 8:00 p.m. to 7:00 a.m.)
with the mitigation proposed by the noise consultant (Attachment 4). The noise consultant's
recommendation is a solid wood fence around the entire enclosure. The project contribution to
the interior noise level of the adjacent residence, 32 dBA, is below the City requirement of 45
dBA.
Radio Frequency (RF) Energy Analysis
A RF report was prepared by Hammett & Edison, Inc. The report estimated the cumulative RF
energy exposures at ground level and the second floor of the nearest residence are well within
the Federal safety standards for RF exposure. In this case, the safety standards for advanced
wireless service and personal communication services are 1.00 mW/cm cellular is 0.58
mW/cm and 700 MHz wireless service is 0.47 mW/cm Ground level cumulative RF
exposure (Verizon & AT&T) was calculated to be 2.5 % of the applicable public exposure limit.
The second floor calculated, cumulative exposure for the nearest residences is expected to be
3.9% of the applicable public exposure limit (Attachment 5).
Tree Removal
The applicant is proposing to remove one tree: a 65-inch, not 25-inch, diameter Monterey Pine
that is in the footprint of the equipment enclosure. The Monterey Pine is infested with Japanese
Pine Beetle. A 36-inch box tree will be required as a replacement for the removed tree and a
planting report will be required of the applicant prior to final sign-off of the project.
Alternatives Analysis
The applicant evaluated seven other potential cell sites in the vicinity of the project site. The sites
are depicted on an aerial map (Attachment 6). The candidate sites are described below followed
by the applicant's analysis: �

In summary, the extensive tree cover and hilly terrain of the area limit the RF coverage of the
various alternative sites. Rancho Deep Cliff is within AT&T's search ring and an antenna
collocation on the Verizon monopine was deemed an optimal solution, rather than constructing a
completely separate facility.
Setback Variance
The property zoning requires that accessory structures meet the setback standards of the
adjacent residential properties, which in this case is three feet from a property line for accessory
structures seven feet or less in height. The applicant is requesting a variance approval to allow
equipment cabinets to be setback eight inches from the property line.
To grant the variance the Planning Commission must make five findings as followed. Staff
comments are in italics:
1) There are special circumstances applicable to the property that do not apply generally to
property in the same district.
According to the applicant(s), this is the only analyzed cell site that meets the functional RF coverage
requirements for both u�ireless carriers: Verizon Wireless and AT�T. Tlze site )ias good line-of-sight

2) The special circumstances applicable to the property deprive the property of privileges
enjoyed by other property in the vicinity and under identical zoning classification.

T{2e common-interest areas of R1C-zoned developments are commonly developed as landscaped
pedestrian u�alkz��ays or recreational facilities. Tl�e project site is a narroz�� portion of t1�e common-
interest area situated betzc�een the rear of a single family residence and tlie rear of apartment buildings.
T71e area is not conducive to tlie development of landscaped pedestrian u�alkzc�ays or recreational
facilities.
3) The issuance of the variance will not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zoning in which such property is
situated.
Tlie only other vicinity properties that are permitted by zoning to host a personal u�ireless sett�ice
facility are: RHS properties, common-interest areas of residential developments, parks, Deep
Cliff Golf Course, Stevens Creek Plaza Shopping Center and Monta Vista Higli Scliool. All of these
otlzer alternative sites zc�ere deemed infeasible by the applicant. Thus, the granting of this variance does
not consfitute a grant of special privileges.
4) The variance is not being issued for the purpose of allowing a use that is not otherwise
expressly authorized by the zone regulation governing the parcel of the property.
Tlie Wireless Communications Facilities Ordinance expressly allou�s tlze construction of personal
zc�ireless service facilities in commonly-oumed areas of residential developments u�ith a use permit
reviezt�.
5) The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the puUlic health, safety, and
general welfare, or convenience, and to secure the purpose of the title.
T7ie facility lias been designed to blend in znith the residential environment and u�ill mitigate noise
impacts. RF energy exposures are estimated fo be u�ell-zc�ithin federal safety standards. Ty�e
availability of zc�ireless communications coverage to tlzis area u�ill improve public conz�enience and
safety.
Public Noticing and TICC/Public Comments
Public hearing notices were mailed to a 1,000-foot property owner radius around Rancho Deep
Cliff. As of October 20, 2011, staff has received no public comments other than as described
below. The project was reviewed by the Technology, Information and Communications
Commissioners (TICC - see Attachment �. The TIC Commissioners were supportive of the
project, noting that the 2009 TICC survey indicated that this area was particularly poor for
wireless coverage; the monopine would replace an existing visible lattice tower and the project
had the proactive support of the HOA. TICC stated that cabinet equipment noise needed to be
studied and abated (Please see Noise discussion above).
The Rancho Deep Cliff HOA also submitted a letter (Attachment 8). Two of the three conditions
requested in the letter apply to the AT&T facility (Staff comments in italics):
1) The applicant shall conduct post-construction noise monitoring at the project site and five
nearby residences (22395, 22415, 22435, 22455 and 22456 Rancho Deep Cliff Drive) to ensure
that equipment complies with all City noise standards. Applicant will bear the cost of

WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use

Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount
of such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later challenging such
exactions.
5. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period
of 18 months, said aerial and associated facilities shall be removed. The applicant shall bear
the entire cost of demolition.
6. EXPIRATION DATE
This use permit shall expire ten (10) years after the effective date of the permit. The applicant
may apply for a renewal of the use permit at which time the Planning Commission may
review the state of wireless communication technologies, camouflage techniques and
maintenance to determine if the visual impact of the aerial facility can be reduced.
7. POST-CONSTRUCTION TESTING OF RADIO FREQUENCY (RF) LEVELS
The applicant shall monitor and report on cumulative RF energy emissions and compare
exposures to the Federal safety standards in mW/cm when both personal wireless service
facilities are operational. If the operation of the second wireless facility is delayed by more
than six months from the operation of the applicant's wireless facility, then the applicant shall

report on only his facility. Emissions testing shall include measurements at sites next to
22395, 22415, 22435, 22455 and 22456 Rancho Deep Cliff Drive and the second story of the
adjacent apartment building. The results of these tests will be made available to the
Planning Department and Rancho Deep Cliff Homeowners' Association for review. The City
reserves the right to perform code enforcement actions and/or revoke this use permit if the
results show RF exposure levels in excess of the applicable federal standards.
8. POST-CONSTRUCTION TESTING OF NOISE LEVELS
The applicant shall monitor and report on cumulative noise levels and compare them to City
daytime and nighttime noise standards when both personal wireless service facilities are
operational. If the operation of the second wireless facility is delayed by more than six
months from the operation of the applicant's wireless facility, then the applicant shall report
on only his facility. Noise testing shall include measurements at sites next to 22395, 22415,
22435, 22455 and 22456 Rancho Deep Cliff Drive and the property line abutting the adjacent

other entitlements to use which regulate the subject property including, but not limited to, adherence
to the following specific criteria:
a) Design harmony between the new collocated antennas and existing trees have been preserved
and the materials, textures and colors of the new monopine harmonize with adjacent
landscaping and preserve the future character of the neighborhood and purposes of the zone
in which it is situated. The location, height and materials of walls, fencing, hedges and screen
planting harmonize with adjacent development. Unsightly utility installations have been
concealed. Ground cover or various types of pavements have been used to prevent dust and
erosion, and the unnecessary destruction of existing healthy trees have been avoided to the
extent practical.
b) This new development, abutting an existing residential development, has been designed to
protect residents from noise, traffic, light and visually intrusive effects by use of buffering,
setbacks, landscaping, fences and other appropriate design measures.

The applicant/property owner is responsible to verify all pertinent property data including but not
limited to property boundary locations, building setbacks, property size, building square footage,
any relevant easements and/ or construction records. Any misrepresentation of any property data
may invalidate this approval and may require additional review.
3. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file nos. U-2011-02, V-2011-02 and TR-2011-65 shall be
applicable to this approval.
4. DEVELOPMENT APPROVAL
Architectural and Site Approval is granted for the architectural design and site planning for a
personal wireless service facility consisting of twelve panel antennas collocated on a previously
approved, but unbuilt, 70-foot tall monopine and associated equipment enclosure.
The Planning Conunission shall review amendments to the project considered major by the Director
of Community Development.
5. MONOPINE & ANTENNA APPEARANCE AND MAINTENANCE
The applicant shall construct a personal wireless service facility that achieves a tree-like appearance
and satisfactorily camouflages exposed equipment by implementing the design criteria below:
a) Use a sufficient number of artificial branches of sufficient lengths to obscure the appearance of the
panel antennae and any associated mounting framework.
b) Panel antennae mounted away from the mast shall be painted green to match the foliage of the
monopine. The antennae mounting hardware and RRU's shall also be painted green to match the
foliage of the monopine.
c) All panel antennae shall have needle covers to blend with the foliage of the monopine.
d) Cabling shall be internalized withixi the mast of the personal wireless service facility.
The building permit shall be reviewed and approved to the satisfaction of the Community
Development Director to ensure the above condition is met. The applicant shall perform regular
maintenance of the monopine to maintain its appearance and obscure the panel antennae from public
view.

6. EQUIPMENT ENCLOSURE
The equipment enclosure shall be completely enclosed with a redwood fence. Vinyl slats proposed
for the chain link fence shall be deleted.
7. TREE REPLACEMENT & RELANDSCAPING
The removed tree shall be replaced with a 36-inch box tree planted in the general vicinity of the
project. Ground cover areas that are disturbed by construction activities shall also be restored by the
applicant. Final tree location shall be reviewed and approved by the Director of Community
Development prior to issuance of building permits. Applicant shall provide a letter from a landscape
architect, certifying that the newly planted tree and other replaced landscaping are in good health
and the irrigation system is operating properly to maintain the vegetation.

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
Variance, as described on Section I. of this Resolution; and
WHEREAS, the necessary notices have been given in accordance with the Procedural Ordinance
of the City of Cupertino, and the Planning Commission has held one or more Public Hearings
on this matter; and
WHEREAS, the Planning Commission finds that the applicant has met the burden of proof
required to support this application, and has met the following findings in order to grant the
variance:
1) There are special circumstances applicable to the property that do not apply generally to
property in the same district, in that according to the applicant(s), this is the only analyzed
cell site that meets the functional RF coverage requirements for both wireless carriers:
Verizon Wireless and AT&T. The site has good line-of-sight down Stevens Canyon
Road/Foothill Boulevard and all properties downslope to Stevens Creek without the
obstruction of trees and hilly terrain that made the seven alternative sites nonviable for the
applicant. In addition the location is well-screened by shorter trees, with reasonable access to
needed utilities and has a willing property lessor. In addition, the proposed cell site location
on the project property will result in the least amount of visual impacts to the surrounding
neighborhood.
2) The special circumstances applicable to the property deprive the property of privileges
enjoyed by other property in the vicinity and under identical zoning classification. The
common open space areas of R1C-zoned developments are commonly developed as
landscaped pedestrian walkways or recreational facilities. The project site is a narrow
portion of the common-interest area situated between the rear of a single-family residence
and the rear of an apartment building. The area is not conducive to the development of
landscaped pedestrian walkways or recreational facilities.

3) The issuance of the variance will not constitute a grant of special privileges inconsistent with
the limitations upon other properties in the vicinity and zoning in which such property is
situated. The only other vicinity properties that are permitted by zoning to host a personal
wireless service facility are: RHS-zoned properties, common open space areas of residential
developments, parks, Deep Cliff Golf Course, Stevens Creek Plaza Shopping Center and
Monta Vista High School. All of these other alternative sites were deemed infeasible by the
applicant. Thus, the granting of this variance does not constitute a grant of special privileges.
4) The variance is not being issued for the purpose of allowing a use that is not otherwise
expressly authorized by the zone regulation governing the parcel of the property. The
Wireless Communications Facilities Ordinance expressly allows the construction of personal
wireless service facilities in commonly-owned areas of residential developments with a use
permit review.
5) The granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, and
general welfare, or convenience, and to secure the purpose of the title. The facility has been
designed to blend in with the residential environment and will mitigate noise and geologic
impacts. RF energy exposures are estimated to be well-within federal safety standards. The
availability of wireless communications coverage to this area will improve public
convenience and safety.
NOW, THEREFORE, BE IT RESOLVED:

1. APPROVED REMOVALS
Approval is based on Exhibits titled: "AT&T/CN4008/RANCHO DEEP CLIFF/ 22475 RANCHO
DEEP CLIFF DRIVE/CUPERTINO, CA 95014" prepared by Connell Design Group, LLC dated
10/04/11 and consisting of nine sheets labeled T1, F1, C-1, A1, A2, A2.1, A3, A4 and A5, except as
may be amended by the conditions contained in this resolution.
Resolution No. 6677 TR-2011-65 October 25, 2011
2. CONCURRENT APPROVAL CONDITIONS
The conditions of approval contained in file no. U-2011-02, ASA-2011-18 and V-2011-02 shall be
applicable to this approval.
3. REQUIRED TREE REPLACEMENTS
The removed tree shall be replaced with a 36-inch box tree planted in the general vicinity of the
project. Ground cover areas that are disturbed by construction activities shall also be restored by the
applicant. Final tree location shall be reviewed and approved by the Director of Community
Development prior to issuance of building permits. Applicant shall provide a letter from a landscape
architect, certifying that the newly planted tree and other replaced landscaping are in good health and
the irrigation system is operating properly to maintain the vegetation.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Goverxlment Code Section
66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and
a description of the dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees, dedications, reservations, and
other exactions, pursuant to Governrnent Code Section 66020(a), has begun. If you fail to file a protest
within this 90-day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
