AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING GENERAL PLAN POLICIES 2-33, REGARDING NEIGHBORHOOD GATEWAYS, AND 6-17 REGARDING PRIVATE RESIDENTIAL ENTRY GATES THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: General Plan Policy 2-33 is hereby amended to read as follows: Define neighborhood entries through architecture, landscaping, or land forms appropriate to the formal or rural character of the neighborhood. Prohibit DiseauFage electronic security gates, walls and fences except in large, multiple -family attached developments (25 units or more), because theyse isolate individual developments and/or create barriers to emergency services. However, there are some situations where electronic security gates could be allowed, through a fence exception application, if the development meets at least one of the following criteria: • Is visible and easily accessible from a mai or thoroughfare and constitutes a potential opportunity for crime. • Is a mixed-use development, where the parking for different uses needs to be separate. • Includes a below -grade parking structure where the gates are required to secure the below -grade parking_ • Requires gates to obtain federal or state funding • Is designed for a special population needing_ greater security, such as seniors. (New text, follows "Road Access"page 6-17.) ACCESS TO RESIDENTIAL DEVELOPMENTS Fire and other emergency personnel may be impeded if there are electronic security gates on residential developments. Therefore electronic security gates should be prohibited in all residential developments except large, multiple -family attached developments (25 units or more), except when granted a fence exception if certain criteria are met.
