Reso 4958 3 11-Z-97 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4958 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF INTERIM ORDINANCE 1799, AN AMENDMENT TO TITLE 19, CHAPTER 19.28 SINGLE FAMILY ORDINANCE OF THE CUPERTINO MUNICIPAL CODE WHEREAS, the City of Cupertino initiated an application for modification to the single family residential ordinance (11-Z-97) affecting all properties within said zone; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and WHEREAS, the Planning Commission finds that the subject zoning modification meets the following requirements: a) That the City of Cupertino is conducting a city-wide single family residential survey. The goal of the survey is to identify architectural styles so that citywide architectural standards can be adopted. b) As an outcome to this survey, the issue of building mass, bulk, height, privacy and neighborhood compatibility will be addressed through the adoption of architectural standards which is estimated to be adopted in February 1999. c) In order to preserve the quality of life for property owners adjacent to new second story homes or additions, it is necessary to adopt interim measures to address privacy until the architectural standards can be adopted. d) The City Council believes that a significant amount of building permits will be issued for second story buildings and additions before the comprehensive zoning modifications can be completed. Because public testimony indicates a great public concern about privacy impacts from the new second story buildings they feel it necessary to protect impacted property owners until further modifications to the zoning code can be completed. 4 e) As such, it is necessary to adopt an interim ordinance addressing privacy protection in order to protect the public safety, health and welfare until comprehensive zoning modifications can be completed.
