APPROVING AN ARCHITECTURAL REVIEW OF A NEW 5,657 SQ. FT. SINGLE FAMILY
RESIDENCE
SECTION I: PROJECT DESCRIPTION

Location: Cristo Rey Drive, Unit l, Lot 12 of the Oak Valley Development
SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the
surrounding area.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application no. 11-ASA-98, is here by approved and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 11-ASA-98, as set forth in the
Minutes of Planning Commission Meeting of August 10, 1998, and are incorporated by reference
herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMM UNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on elevations dated July 27, 1998; floor plan and cross sections dated July
31, 1998; site plan, no date; and color and material board, except as may be amended by
conditions in this resolution.
2. GARAGE POP-OUT
The garage pop-out shall either be removed or changed into a bay window or architectural
feature that is allowed to project 3' into the front setback, as determined by staff.

3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
such fees, and a description of the dedications, reservations, and other exactions. You are hereby
further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
you fail to file a protest within this 90-day period complying with all of the requirements of Section
66020, you will be legally barred from later challenging such exactions.
