� AN EXISTING LIGHT INDUSTRIAL BUILDING FROM 22 TO 30 FEET

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for
architectural approval as described in this Resolution; and
WHEREAS, the Planning Commission finds the changes are beneficial and compatible with the
� surrounding area; and

NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the building modifications described above are hereby approved subject to the conditions which
are enumerated in this Resolution; and

That the subconclusions upon which the findings and conditions specified in this Resolution are based
� and contained in the Public Hearing record concerning Application 8-ASA-98, as set forth in the
( Minutes of the Planning Commission Meeting of July 27, 1998, and are incorporated by reference
herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
All conditions of approval for application 6-ASA-97 remain in effect, except as modified by this
resolution. Approval of the height modification is approved based upon the color board, Sheet A2 -
dated 6/12/98 - Site Plan (Project Description, Master Site Plan, Parking Site Plan, and Landscape
Plan, Sheet A3 - dated 6/12/98 - Elevations, except as may be amended by the conditions contained
in this resolution.

2. LANDSCAPE REVIEW
The approved landscape plan shall be modified to add new 24" box Coastal Redwood trees or
� other trees recommended by an International Certified Arborist to fill in the gaps along the
perimeter landscaping.

r 3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
r requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of
� such fees, and a description of the dedications, reservations, and other exactions. You are hereby
` further notified that the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If
' you fail to file a protest within this 90-day period complying with all of the requirements of Section
� 66020, you will be legally barred from later challenging such exactions.
� PASSED AND ADOPTED this 27th day of July, 1998, at a Regulaz Meeting of the Planning
Commission in the City of Cupertino by the following roll call vote:
