Reso 4947 10-ASA-98 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4947 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN ARCHITECTURAL REVIEW TO MODIFY THE COLORS AND SITE PLAN OF AN APPROVED HOTEL SECTION I: PROJECT DESCRIPTION Application No.: 10-ASA-98 Applicant: Taisei Construction Location: 10741 N. Wolfe Road � SECTION II: FINDINGS � WHEREAS, the Planning Commission of the City of Cupertino received an application for an I Architectural and Site Approval, as described in this Resolution; and WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the surrounding area. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this ( matter, the application no. 10-ASA-98, is here by approved and ` That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application 10-ASA-98, as set forth in the Minutes of Planning Commission Meeting of July 27, 1998, and are incorporated by reference herein. SECTION III: CONDITIONS ADMINISTERED BY THE COMM UNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on Sheets 1-3 dated 6/18/98 and the color elevation (Paint color ICI 183, � Farmer's Almanac), except as may be amended by the conditions in this resolution. 2. COLOR The color of the base shall be intensified. 3. PATIO WALLS ON WEST ELEVATION The patio walls on the west elevation shall be more open and more architecturally interesting, to the satisfaction of staff. Resolution No. 4947 10-ASA-98 July 27, 1998 Page -2- 4. PARKING The overflow parking agreement shall provide enough spaces for 165 rooms, less the on-site spaces. 5. PRIOR APPROVALS All conditions of approval of prior approvals shall be in effect, unless they are in conflict with the conditions of this resolution. 6. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, � reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section � 66020, you will be legally barred from later challenging such exactions.
