Reso 4921 5-EXC-98 `' CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 I r ` RESOLUTION NO. 4921 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO ' APPROVING A SIGN EXCEPTION TO ALLOW ONE 8'6" HIGH � LOGO SIGN PROJECTED ABOVE THE ROOF LINE OF THE I CUPERTINO CITY CENTER OFFICE BUILDING LOCATED AT 20450 STEVENS CREEK BOULEVARD � ' SECTION I: PROJECT DESCRIPTION ( Application No.: 5-EXC-98 Applicant: Cupertino City Center Buildings, Inc. � AMCOE Sign Co./Steve Coulthard Location: 20450 Stevens Creek Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for an exception to the Sign Code, as described in this Resolution; and WHEREAS, the Planning Commission finds the following with regards to this application: a) That the literal enforcement of the provisions of this title will result in restrictions inconsistent with the spirit and intent of this title, in that a regulation-sized wall si�;n would be difficult to see from the adjacent street and a sign projecting above the roof line of the subject building would not necessarily have negative aesthetic effects. b) That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or welfare, in that potential glare from sign illumination can be alleviated by using a reverse pan channel letter design and adjusting wattage and sign materials; and Resolution No. 4921 5-EXC-98 May 11, 1998 Page -2- � � a) That the exception to be granted is one that will require the least moditication of the � prescribed regulations and the minimum variance that will accomplish the purpose, in � that the larger wall sign is not disproportionate to the size and setback of the buildin� and is moderately identifiable from the street given its proposed size. � NOW, THEREFORE, BE IT RESOLVED: r ( That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the exception to the sign program is hereby approved subject to the conditions which are enumerated in this Resolution; and � That the subconclusions upon which the findings and conditions specitied in this � Resolution are based and contained in the Public Hearing record concerning Application � 5-EXC-98, as set forth in the Minutes of the Planning Commission Meeting of May 1 1, � 1998, and are incorporated by reference herein. I � SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS The approval is based on exhibits titled: "Cupertino City Center, 20450 Stevens ; Creek Blvd., Cupertino, CA" consisting of two sheets labeled 1 and 3 of 4 and dated , 1/16/98 (for sheet #1) and 1/19/98 (for sheet #3), except as may be amended by thc � Conditions contained in this Resolution. 2. LOGOS FOR PRIMARY BUILDING TENANTS The allowed logo sign is limited to primary building tenants who occupy more than 50% of the office building square footage. � 3. VISIBLE SIGN SURFACES Visible sign surfaces, including the logo and background, shall have a matte tinish. The sign background shall match the panel treatments of the adjacent panels at the same elevation. The Director of Community Development shall approve the sign background color. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS � The Conditions of Project Approval set forth herein may include certain fees, � dedication requirements, reservation requirements, and other exactions. Pursuant to i Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notitied that the 90-day � approval period in which you may protest these fees, dedications, reservations, and � other exactions, pursuant to Government Code Section 66020(a), has begun.
