Reso 4919 1-GPA-98 CITY OF CUPERTINO 1- 10300 Torre Avenue Cupertino, California 95014 � RESOLUTION NO. 4919 OF THE PLANNING COMMISSION OF THE CITY OF CUPERT[NO RECOMMENDING APPROVAL OF A GENERAL PLAN AMENDMENT TO REVISE THE TEXT OF POLICY NO. 2-42 TO ALLOW MINOR ADJUSTMENTS � IN THE CITY'S URBAN SERVICE AREA/SPHERE OF [NFLUENCE , BOUNDARY BETWEEN CUPERTINO AND ADJACENT CIT[ES FOR ONLY URBANIZED, VALLEY FLOOR LOCATIONS AS DESCRIBED IN EXHIBIT "A" WHEREAS, the Planning Commission of the City of Cupertino received an application to expand � its Urban Service Area/Sphere of Influence (USA/SOI), as described on this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and WHEREAS, the Commission found the application to be de minimus in accordance with its minute order, Resolution No. 4918, adopted at its regular meeting held on April 22, 1998; and WHEREAS, the Commission determined that General Plan Policy No. 2-42 was intended to prohibit the City of Cupertino's outward expansion into the hillside areas, but had the unintended effect of prohibiting all urban service area expansions, including adjustments in boundaries between Cupertino and adjacent cities; and WHEREAS, there may be opportunities in the future for Cupertino to establish more logical and efficient city boundaries by adjusting boundary lines upon mutual agreement oti affected cities and Local Agency Formation Commission; and WHEREAS, a revision to the text of General Plan Policy No. 2-42 is necessary to create this flexibility for the City as described in Exhibit "A" NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for general plan amendment, file no. 1-GPA-98, is hereby recommended for approval as described in Exhibit A, by the Planning Commission of the City of Cupertino. The intent of this policy is to limit future development to lands within the existing urban service area.
