Reso 4916 5-Z-98 � CITY OF CUPERTINO 10300 Torre Avenue, Cupertino, California 95014 � RESOLUTION NO. 4916 ( OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO � RECOMMENDING APPROVAL FOR A PREZONING OF APPROXIMATELY 317 NET ACRES OF RESIDENTIALLY DEVELOPED � LAND FROM COLJNTY TO PRE- R1-5, PRE- R1-6, PRE- R1-7.5 AND PRE- R1-10, ( SINGLE FAMILY RESIDENTIAL, AND A PREZON[NG OF PRE-BQ, ► QUASI-PUBLIC/INSTITUTIONAL, FOR AN EXISTING COMMUNITY CENTER LOCATED IN TERRITORY BOUNDED BY MILLER AVENUE, STEVENS CREEK BOULEVARD, LAWRENCE EXPRESSWAY, BOLLINGER ROAD AND TANTAU AVENUE AND AS DESCRIBED IN EXHIBITS "A," "B," "C," "D," "E," AND "F" I _________________________________ ----------- SECTION L• FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a prezoning of unincorporated territory, as described on this Resolution; and � WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of � the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and WHEREAS, the Planning Commission finds that the subject prezoning meets the following requirements: a) That the prezoning is in conformance with the General Plan of the City of Cupertino, and is consistent with the existing uses on the subject lots. b) That the property involved is adequate in size and shape to conform to the new zoning , designation. c) That the new prezoning encourages the most appropriate use of land. � d) That the proposed prezoning is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of subject parcels. � e) That the prezoning promotes the orderly development of the city. � � That the prezoning is necessary before the city can initiate annexation proceedings. g) That the prezoning development standards and City subdivision standards will preclude the subdivision of the larger cul-de-sac lots in the prezoning areas. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for prezoning is hereby recommended for approval; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 5-Z-98 as set forth in the Minutes of the Planning Commission Meeting of Apri122, 1998, and are incorporated by reference as though fiully set forth herein.
