� SECTION II: FINDINGS

i WHEREAS, the Pla.nning Commission of the City of Cupertino received an application for an
Architectural and Site Approval, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the:
1) The current dense tree coverage significantly limits the retail establishments visibility.
2) The replanting plan calls for a replacement ratio of 1.4 trees for each one removed. The size of the
� replacement trees are 24" box. The species types are higher branching and canopies are not as
� dense as existing trees.
( NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application no. 4-ASA-98, is here by approved and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning Application 4-ASA-98 as set forth in the
Minutes of Planning Commission Meeting of April 27, 1998, and are incorporated by reference herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
The recommendation of approval is based upon Exhibits: L1, L2, and I4 dated revised Apri121,
1998 and L3 dated March 27, 1998, and the conditions set forth in this Model Resolution.

2. TREE PROTECTION
The Planning Commission approves the removal of trees as identified on plan L2. The
I replanting shall occur within 90 days of the tree removal.
3. LANDSCAPE REVIEW
The applicant shall submit the affidavit as required in chapter 14.15, Xeriscape Landscaping, of
, the Cupertino Municipal Code.
4. LIGHTING
The relocation of existing lighting is subject to submittal of a lighting contour plan
( demonstrating that the light does not extend beyond the property line.
