RESOLUTION NO. 4899
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A SIGN
EXCEPTION TO EXCEED THE ALLOWED NUMBER OF GROUND AND WALL SIGNS
IN ACCORDANCE WITH TITLE 17 OF THE CUPERTINO MUNICIPAL CODE.
SECTION I: PROJECT DESCRIPTION

Applicant: Chevron Products
Property Owner: Mardesich Company
Location: 10023 De Anza Blvd.
SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a
sign exception as described in this Resolution; and
WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and
has met the following findings for a Sign Exception as required in Section 17.44.040 of the
Cupertino Municipal Code:
1. That the literal enforcement of the provisions of this ordinance will result in restrictions
inconsistent with the spirit and intent of this ordinance;
2. That the granting of the exception will not result in a condition ��vhich is materially
detrimental to the public health, safety, or welfare;
3. That the exception to be granted is one that will require the least modification of the
prescribed regulations and the minimum variance that will accomplish the purpose;
4. That the granting of the exception is consistent with other similar signs in existing service
stations; and "
5. That the exception will allow the signage to be seen from traffic in both directions.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted
in this matter, the Sign Exception, is hereby approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution are
based and contained in the public hearing record concerning Application 2-EXC-98 as set forth
in the Minutes of the Planning Commission Meeting of March 9, 1998, and axe incorporated by
reference herein.
