OF THE CITY OF CUPERTINO PLANNING COMMISSION RECOMMENDING
APPROVAL OF AN ARCHITECTURAL AND SITE APPROVAL (ASA) APPLICATION TO
CONSTRUCT A 43,500+ SQUARE FOOT BUILDING IN A LIGHT INDUSTRIAL ZONING
DISTRICT

1. APPROVED EXHIBITS
That the approval is based on the attached exhibits, including the vicinity map, site plan,
elevations, building 10 plan, and list of building amenities dated January 20, 1998 except
as may be amended by additional conditions enumerated herein. The Planning
Commission shall approve the final building materials and architectural details as an
ASA application.
2. USE LIMITATIONS
The subject application authorizes expansion of an existing industrial/office/research and
development complex of approximately 43,500 sq. feet as generally described in the
exhibits enumerated in Condition 1 above.
The maximum building area for the entire 24 acre property depicted by Exhibit A shall be
based upon a.33 floor area ratio (FAR) and additionally the 20,000 square feet of space
described in the General Plan's office, research and development and industrial growth
development allocation table (Policy 2-3, strategy 3). Said 20,000 square feet of space
shall be assigned to the subject development project phase.

The floor area ratio development capacity for the site is described below as Table 1.
Table 1 approves a floor area space allocation for the entire site including a discounting
of 36701 square feet of amenity space included in the existing building. The table
identifies future building space for the balance of the site as equally 42866 square feet.

To ensure consistency with the City's General Plan floor area ratio requirements for the
entire 24 acre "development site," the developer shall record a final subdivision map
consolidating all existing parcels into a single lot or alternately, the developer may record
appropriate floor area ratio credit transfers between parcels. The form of the credit
transfer shall be approved by the City Attorney prior to issuance of a building permit. A
list of designated amenity space shall be recorded as to inform any future buyers that the
designated amenity space must remain as such.
3. FIRE SAFETY REQUIREMENTS
Concurrently with review of building permits, the developer shall demonstrate
compliance with fire safety equipment requirements as specified by the City.

4. ROOF MOUNTED EQUIPMENT
The developer shall present a solution for screening of roof mounted mechanical
equipment to the Architectural and Site Approval Committee prior to issuance of building
permits.
5. TRAFFIC IMPACT MITIGATION
Prior to issuance of building permits, the developer shall execute an agreement which
shall provide for construction of an improved secondary access from Imperial Avenue to
the subject site upon determination by the City Council that said access will alleviate
future unacceptable congestion at the Bubb Road/Results Way or Bubb Road/McClellan
Road intersection.
6. MODIFICATION OF APPROVED DEVELOPMENT PLAN
In the event that the applicant or subsequent property owner shall desire to make any
minor changes, alterations or amendment of the approved development plan, a written
request or revised development plan shall be submitted to the Director of Community
Development. If the Director makes a finding that the changes are minor and do not
result in a material affect upon the appearance or function of the project, said chan�es
may be certified on the revised plan. If approval of said changes is withheld, the
applicant may appeal to the Architectural and Site Approval Committee.
If said changes are approved by the Architectural and Site Approval Committee, an
appeal may be made to the City Council by any interested party. Further, any member of
the City Council may request a hearing before the City Council regarding said approved
changes.
7. NOISE CONTROL
The applicant shall construct an expanded height sound wall if noise from the loadin�
review dock/truck operations exceeds the consultants noise ordinance standards of 50 dba
during the evening hours and 60 dba during the daytime hours. The single event daytiine
level of 60 dba may be exceeded during brief periods as permitted by the Community
Noise Ordinance. A public hearing shall be conducted by the Planning Commission if
noise complaints are received. If the Commission concludes that noise levels referenced
in the noise ordinance are exceeded, the noise must be abated.
8. LANDSCAPING
The landscaping plan for the existing development area of the total site shall be expanded
to include the subject site. Final selection of plant materials shall be reviewed by the
Planning Commission as an ASA application.

SECTION IV CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT
9. STREET IMPROVEMENTS & DEDICATION
Street widening, improvements, and dedications shall be provided in accordance with
City standards and specifications and as required by the City Engineer.
10. CURB AND GUTTER IMPROVEMENTS
Curbs and gutters, sidewalks and related structures shall be installed in accordance with
grades and standards as specified by the City Engineer.
11. LIGHTING
Street lighting shall be installed and shall be as approved by the City Engineer. On-street
lighting shall be as required by the Architectural and Site Approval Committee and
ordinances and regulations of the City. All on and off-site lighting shall be designed to in
no way interfere with adjacent areas and shall be no higher than the maximum height
permitted by the zone in which the property is located.
12. FIRE HYDRANTS
Fire hydrants shall be located as required by the City.
13. TRAFFIC SIGNS
Traffic control signs be placed at locations specified by the City.
14. STREET TREES
Street trees shall be planted within the public right-of-way and shall be of a type
approved by the City in accordance with applicable standards and ordinances.
15. GRADING
Grading shall be as approved and required by the City Engineer in accordance with
Ordinance No. 214(a).
16. DRAINAGE
Drainage shall be provided to the satisfaction of the City Engineer.
17. UNDERGROUND UTILITIES
The developer shall be responsible for complying with the requirements of the
underground utility ordinance No. 331 and other related ordinances and regulations of the
City of Cupertino, and shall made the necessary arrangements with the utility companies
involved for the installation of said facilities. The developer shall submit a detailed plan
showing utility underground provisions. (This plan must have prior approval of the
utility companies and the City Engineer).

18. DEVELOPMENT AGREEMENT
The project developer shall enter into a development agreement with the City of
Cupertino providing for payment of fees, including but not limited to checking and
inspection fees, storm drain fees, park dedication fees and fees for undergrounding of
utilities. Said agreement shall be executed prior to issuance of construction permits.
19. TRANSFORMERS
Electrical transformers, telephone vaults and similar above ground equipment enclosures
shall be screened with fencing and landscaping or located underground such that said
equipment is not visible from public street areas.
