AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING THE STEVENS CREEK BOULEVARD (HEART OF THE CITY) SPECIFIC PLAN TO CHANGE THE DEVELOPMENT STANDARDS TO ALLOW SINGLE-FAMILY RESIDENTIAL DEVELOPMENT ON CERTAIN PROPERTIES MORE THAN 225 FEET FROM STEVENS CREEK BOULEVARD AND BETWEEN STERN AVENUE AND TANTAU AVENUE WHEREAS, the City Council of the City of Cupertino received an application for an amendment to the Stevens Creek Boulevard Specific Plan; and WHEREAS, the necessary public notices ha�e been given in accordance with the Procedural Ordinance of the City of Cupertino and the City Council has held one or more public hearings on this matter; and WHEREAS, the proposed amendment is consistent with the Cupertino Comprehensive General Plan; and � WHEREAS, the amendment recognizes the viability of existing single-family residences in the specific plan area that are sufficient distance from Stevens Creek Boulevard; WHEREAS, the amendment bars new single-family development on lots nearer to Stevens Creek Boulevard which if combined provides adequate lot depth for non- residential and/or higher density residential development and buffering of adjoinin� single-family residences. NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: that the Stevens Creek Boulevard (Heart of the City) Specfic Plan is hereby amended as shown in Exhibits A-1 & B-1. This ordinance shall take effect and be in force thirty (30) days after its passage. Standards apply to existing lots 10,000 square feet or less in area and 225 feet or more in distance from Stevens Creek Boulevard. 1.03.20 Land Use A. Permitted Uses 1. Single-Family Residential - at a ciensity range o� 1-5 units per acre. 2. Other permitted uses in the R-1 single-family residential zoning district. B. Accessory Uses 1. Customary Home Occupations -subject to City review. 2. Accessory Uses and Buildings -customarily appurtenant to a permitted use. C. Conditional Uses 1. Conditional uses as allowed in the R-1 single-family residential zoning district. 1.03.30 Building Height and Setbacks 1. Building heights and setbacks are as allowed in the R-1 single-family residential zoning district. 1.03.40 Other Site Development Re�ulations 1.
