CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4854 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A MINOR MODIFICATION TO AN APPROVED USE PERMIT REGARDING ARCHITECTURAL, SITE AND LANDSCAPING CHANGES INCLUDING THE ADDITION OF A CAFETERIA SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Yermit Modification, as described in this Resolution; and WHEREAS, the Planning Commission has discussed the changes at the regular scheduled meeting; and � WHEREAS, the applicant has met the burden of proof required to support said application. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Use Permit Modification is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application No. 11-U-96 (Mod.) as set forth in the Minutes of the Planning Commission Meeting of August 11, 1997, and are incorporated by reference though fully set forth herein. SECTION II: PROJECT DESCRIPTION Application No.: 11-U-96 (Mod.) Applicant: Symantec Property Owner: Cupertino City Center Apartment II Location: South DeAnza Boulevard approximately 400 ft. from the intersection of Rodrigues Resolution No. 4854 11-U-96 (Mod.) August 11, 1997 Page-2- SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS/SUBJECT TO MINOR AMENDMENTS DESCRIBED BELOW The approval based upon Exhibits labeled "Ground Floor Plan - Proposed Revisions" dated 7/21 /97, "Cafeteria Addition - Plan" dated 7/28/97, "Symantec Outdoor Eating Area and Water Feature" dated 7/17/97, West Elevation -"Proposed Revision" dated 7/21/97, "South Elevation - Proposed Revision" dated 7/21/97 and East Elevation - Proposed Revision dated 7/21/97. The fourth-story balconys located in the south elevation of each wing of the building shall be '' retained. The stair design, including tread and riser design and materials, is not recommended for approval. The applicant shall resubmit a plan for Planning Commission approval. ,�� 2. PREVIOUS CONDITION ' All previously adopted conditions of approval for Application No. 11-U-96, shall remain in force with the exception that architectural, site, and landscaping changes identified above shall prevail in case of a conflict.
