Reso 4826 5-EXC-97 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4826 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A SIGN EXCEPTION TO LOCATE 4 TENANT SIGNS ON WEST ELEVATION OF EXISTING RETAIL BUILDING, IN ACCORDANCE WITH CHAPTER 17.04 OF THE CUPERTINO MUNICIPAL CODE SECTION I: PROJECT DESCRIPTION Application No.: 5-EXC-97 Applicant: (Dominic Giacalone) Imwalle Stegner Location: 10745 South DeAnza Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for an exception to the Sign Code, as described in this Resolution; and WHEREAS, the Pla.nning Commission finds the following with regard to this application: a) That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent with the spirit and intent of this ordinance; b) That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or welfare; and c) That the exception to be granted is one that will require the least modification of the prescribed regulations and the minimum variance that will accomplish the purpose. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, e�chibits, testimony and other evidence submitted in this matter, the exception to the sign program is hereby approved subject to the conditions which are enumerated in this Resolution; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 5-EXC-97, as set forth in the Minutes of the Planning Commission Meeting of March 24, 1997, and are incorporated by reference herein. Resolution No. 4826 5-EXC-97 March 24, 1997 Page -2- SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. Approved Exhibits Approval is based on the Cal-Neon site plan, except that only tenants with rear doors are allowed signs on the west elevation, which shall be the same size as the front signs (18" high, 70% length). If the southern-most tenant has a rear door, then a sign the same size as the northern-most tenant is allowed. The sign shown on the north elevation is not approved. 2. Total Wall Sign Area Total wall sign area, including permanent window signs, shall comply with the sign code prior to issuance of building permits for the west elevation signs.
