OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
' RECOMMENDING APPROVAL OF AN AMENDMENT TO THE
HEART OF THE CITY SPECIFIC PLAN BY ORDINANCE TO REAFFIRM
THE TR.ANSFER OF 141,000 SQUARE FEET OF OFFICE DEVELOPMENT
ALLOCATION FROM APPLE COMPUTER TO SYMANTEC CORPORATION
FOR AN OFFICE BUILDING PROJECT IN THE CITY CENTER AREA
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for an
amendment to the Heart of the City Specific Plan as described in this Resolution; and
WHEREAS, the necessary notices have been given in accordance with the Procedural Ordinance of the
City of Cupertino, and the Planning Commission has held one or more Public Hearings on this matter;
and
WHEREAS, the Planning Commission finds that:
1) the Planning Commission recommended approval of a transfer of 141,000 square feet of
office development allocation from Apple Computer to Symantec Corporation for an office
project at City Center and that the specific plan text amendment was adopted by resolution
no. 4741 at a public hearing conducted by the Planning Commission on August 26, 1996;
2) the Heart of the City Specific Plan must be amended by the City Council by ordinance,
rather than by resolution, for the specific plan to be amended;
3) this resolution and attached ordinance reaffirms the decision and vote of the Planning
Commission taken on August 26, 1996 and this amendment is described in E�iibit "A-1";
4) the specific plan amendment is consistent with the Cupertino General Plan.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, e�ibits, testimony and other evidence submitted in this
matter, the Heart of the City Specific Plan Amendment, is hereby recommended for approval and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the public hearing record concerning this Amendment to the Heart of the City
Specific Plan as set forth in the Minutes of Planning Commission Meeting of February 10, 1997, and
are incorporated by reference herein.

WHEREAS, the City Council of the City of Cupertino has received an application lo amcncl thc
Stevens Creek Boulevard Specific Plan (Heart of the City) from the Plannin� Commission; and
WHEREAS, the Planning Commission has noticed and held at least one public hcarin`, ��n lhc
specific plan amendment proposals and has made a written recommendation on the proposal�; ancl
WHEREAS, the City Council has conducted at least one noticed public hearin� on thc �rc���oscd
specific plan amendments attached hereto as Exhibit "A-1" and "B-1" and tinds that:
1) the amendments provide a mixture of land uses in the City Center area tl�at would bcltcr
promote the goal of increasing pedestrian activity; and
2) the amendments define maximum building heights in keeping with City urban desi�,n
concepts, particularly in stepping buildings away from the street; and
3) the City Council approved the transfer of 141,000 square feet of office developmcnl ailc�ca�ion
from Apple Computer to Symantec Corporation for an office project at City Centcr on Sc��lcn�bcr
I 3, 1996 and that the specific plan was not amended by ordinance as required by slatc la�v;

4) this ordinance rectifies this oversight and reaffirnis the decision of the City Council takc;n at
