OF THE PLANNING COMMISSION OF THE C[TY OF CUPERTINO
RECOMMENDING DENIAL OF A PREZONING FROM
COUNTY TO PRE-R1-10 FOR THE FOLLOWING PROPERTIES:
20711 HANFORD DRIVE, 21123 GRENOLA DRIVE, 20710 DUNBAR DRIVE,
10494 ANN ARBOR AVENUE, 20973 GREENLEAF DRIVE, 21141 GRENOLA
DRIVE, 10495 ANN ARBOR AVENUE, 20861 GREENLEAF DRIVE,
20833 GREENLEAF DRNE, 20889 GREENLEAF DRIVE AND ]0351 N. STELLING ROAD,
LOCATED IN THE CUPERTINO URBAN SERVICE AREA AND TOTALING 2.6 NET ACRES AS
DESCRIBED IN EXHIBITS "A" AND "B"
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for prezoning of
unincorporated properties, as described on this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of
the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject
application; and
WHEREAS, the Planning Commission finds that the subject prezoning:
a) Is not a comprehensive or logical approach to prezone the unincorporated Garden Gate area.
b) Should be accomplished to encourage property owners to develop their properties in the City, rather
than, in the County.
c) Is premature because affected owners and neighboring residents were not adequately educated before
the hearing was held.
d) That the proposed prezoning facilitates the annexation of unincorporated Garden Gate to the City and
numerous residents do not want to be annexed. The Commission wants residents to have choice in thc
matter.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for prezoning is hereby recommended for denial; and
That the subconclusions upon which the findings and conditions specified in this Resolution are based and
contained in the Public Hearing record concerning Application 2-Z-97 as set forth in the Minutes of the
Planning Commission Meeting of January 27, 1997, and are incorporated by reference as though fully set
forth herein.

CUPERTINO ADOPTING ORDINANCE NO. TO PREZONE
FROM COUNTY TO PRE-R1-10 THE FOLLOWING PROPERTIES:
20711 HANFORD DRIVE, 21123 GRENOLA DRIVE, 20710 DUNBAR DRIVE,
10494 ANN ARBOR AVENUE, 20973 GREENLEAF DRIVE, 21 141 GRENOLA
DRIVE, 10495 ANN ARBOR AVENUE, 20861 GREENLEAF DRIVE,
20833 GREENLEAF DRIVE, 20889 GREENLEAF DRIVE AND 10351 N. STELLING ROAD,
LOCATED IN THE CUPERTINO URBAN SERV[CE AREA AND TOTALING 2.6 NET ACRES
WHEREAS, the City initiated the prezoning of numerous unincorporated lots as described above and locat�d in an
area commonly known as the Garden Gate area (Application 2-Z-97); and
WHEREAS, upon due notice and after public hearing by the Planning Commission, the Commission recommcndcd
to the City Council that the Prezoning be approved; and
WHEREAS, the property to be prezoned is presently zoned County R1-10 district; and
WHEREAS, a map of the subject properties are attached hereto as Exhibit "A" as a proposed amendment to the
Master Zoning Map of the City of Cupertino.
WHEREAS, the subject properties are listed and described in Exhibit "B"
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
ection 1. That the properties described in attached Exhibits "A" and "B" are hereby prezoned to pre-R I- I 0, and
that Exhibit "A" attached hereto is made part of the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30) days after its passage.
