Reso 4786 14-ASA-96 CITY OF CUPERTINO 10300 Torre Avenue � Cupertino, California 95014 RESOLUTION NO. 4786 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN ARCHITECTURAL AND SITE APPROVAL TO LOCATE AN UNMANNED RADIO TELECOMMUNICATIONS FACILITY CONSISTING OF 6 ANTENNAS AND TRANSMITTER EQUIPMENT ON AN EXISTING HOTEL BUILDING AT 10889 N. DE ANZA BOULEVARD SECTION I: PROJECT DESCRIPTION Application No.: 14-ASA-96 Applicant: Whalen and Company Property Owner: Forge-Vidovich Location: 10889 N. De Anza Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for � Architectural and Site Approval, as described in this Resolution; and WHEREAS, the Planning Commission finds that the project meets the objectives of the wireless communications facilities ordinance: 1) To facilitate the development of a wireless communications infrastructure in the City for commercial, public and energy uses, and; 2) To protect the health, safety, welfare and aesthetic concerns of the public by reducing the visual impact of the antennas by reducing their height and setting them back from the building parapet. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, Application No. 14-ASA-96, is hereby approved and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application No. 14-ASA-96 as set forth in the Minutes of Planning Commission Meetings of October 28 and December 9, 1996, and are incorporated by reference herein. Resolution No. 4786 14-ASA-96 December 9, 1996 Page -2- I SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT 1. APPROVED EXHIBITS The recommendation of approval is based on exhibits page T-1 revision B, page C-1 revision A, page A-1 revision B titled, page A-2 revision B and page A-3 revision B. 2. ABANDONMENT OF SANITARY SEWER EASEMENT Prior to building permit approval, the applicant shall obtain an abandonment of the sanitary sewer easement along the west side of the property from the Cupertino Sanitary District. 3. ABANDONMENT OF AERIAL If after installation, the aerial is not used for its permitted purpose for a continuous period of 18 months, said aerial and associated facilities shall be removed. The applicant shall bear the entire cost of demolition.
