OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING
A MASONRY WALL AND LANDSCAPING, AND FENCING AND LANDSCAPING
FOR LOT #7 AS REQUIRED BY CONDITIONAL USE PERMIT, APPLICATION
NO. 14-U-96 FOR A 7-LOT PLANNED DEVELOPMENT ON PENINSULA AVENUE

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application to approve a
masonry wall, landscaping and fencing, as described in this Resolution; and
WHEREAS, the Planning Commission finds that the changes are beneficial and compatible with the
surrounding area.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, e�ibits, testimony and other evidence submitted in this
matter, the building modifications described above are hereby approved subject to the conditions which
are enumerated in this Resolution; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 18-ASA-96 set forth in the Minutes
of the Planning Commission Meeting of November 25, 1996, and are incorporated by reference as
though fully set forth herein.
SECTION III• CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
Approval is based on E�iibits titled, "Peninsula Seven" and consisting of three sheets numbered l,Cl
and L1 last dated 8/30/96, except as may be amended by the Conditions contained in this Resolution.'
2. MASONRY WALL
The approved masonry wall is the "grapestake pattern" option. The masonry wall shall be reduced to a
maximum height of three (3) feet within 20 feet of the sidewalk in front of Lot #2.

3. LANDSCAPING
The shrubs planted along the Stevens Creek Boulevard masonry wall shall be 5-gallon size. One street
tree shall be planted at the Stevens Creek Boulevard corner closest to the Souther Pacific railroad
tracks. Sod lawn shall be planted in the unlandscaped, fenced areas of Lot #7.
4. IRRIGATION
An irrigation plan shall be provided for all ASA-approved landscaped areas prior to occupancy permit
approval.
