Reso 4763 16-ASA-96 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4763 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING ARCHITECTURAL REVIEW FOR FREE-STANDING GARAGES, CARPORTS, TRASH ENCLOSURES, ROOF-TOP GARDEN AND REVISED PARKING PLAN SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for an Architectural and Site Approval, as described in Section II. of this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirements: I 1) The proposed buildings are consistent in design, material and color to the approved apartment buildings; NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Architectural and Site Approval is hereby approved subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application 16-ASA-96 set forth in the Minutes of the Planning Commission Meeting of October 28, 1996, and are incorporated by reference though fully set forth herein. i SECTION II: PROJECT DESCRIPTION Application No.: 16-ASA-96 Applicant: Citation Homes Property Owner: PSS Ventures, LLC/Citation Homes Location: Corner - DeAnza Boulevard and Homestead Road Resolution No. 4763 16-ASA-96 October 28, 1996 Page-2- SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS MacKay & Somps site plan dated revised 10/16/96, Isaacson, Wood & Associates plans L3, L4 & LS dated 10/21/96 and the Scheurer Architects, Inc. plans #l, 2, 3, 4, 5 dated August 9, 1996. 2. BUILDING MATERIALS & COLOR The carports, detached garages and trash enclosures shall match in building materials and colors to the approved materials and colors of application 8-U-94 (Modified) as called out in the plans and approved material board. 3. LANDSCAPING The landscape plan shall be modified at the building permit stage to include majestic Qeauty shrub between each garage door of the detached garages. Also vines shall be added to tlie roottop � planting boxes (Sheet LS). The goal is to choose vines (e.g. bougainvillea and Wisteria) that will grow atop the roof trellis. I 4. ROOFTOP USE RESTRICTIONS This area shall be restricted to adults over 18 years of age.
