Reso 4746 12-ASA-96 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4746 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN ENHANCE SPECIALIZED MOBILE RADIO AERIAL FACILITY ON A DEVELOPED HOTEL SITE AT 10889 NORTH DE ANZA BOULEVARD SECTION I: PROJECT DESCRIPTION Application No.: 12-ASA-96 Applicant: Nextel Property Owner: Forge-Vidovich Motel Limited Partnership Location: 10889 North De Anza Boulevard SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for Architectural and Site Approval, as described in this Resolution; and WHEREAS, the Planning Commission finds that the: 1) applicant has examined alternative sites for clustering or collocating aerial facilities to reduce visual impacts and found the sites technically unsuitable for the aerial; 2) proposed aerial has been sited and designed to minimize its visual impact at the prefened location; 3) proposed aerial and associated facilities will not reduce parking required by the City; and 4) the ESMR technology and power output complies with federal ANSI safety standards for radio frequency emissions. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, e�ibits, testimony and other evidence submitted in this matter, the application for architectural and site approval for an ESMR aerial facility is hereby approved and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the public hearing record concerning Application No. 12-ASA-96 as set forth in the Minutes of Planning Commission Meeting of September 9, 1996, and are incorporated by reference herein. Resolution No. 4746 12-ASA-96 September 9, 1996 Page -2- SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT 1. APPROVED EXHIBITS The recommendation of approval is based on Exhibits titled, "Specialized Mobile Radio Facility, Site Name: Junipero Serra, Site Number SF-341A, consisting of 6 sheets and labeled Sheet No. T-1, C-1, A-1, A-2 and two unnumbered sheets: one titled "Line of Sight Plan" and the other titled "Line of Site Elevations"" except as may be amended by the Conditions contained in this Resolution. 2. AERIAL COLORS The applicant shall paint the aerials to blend with the color of the hotel wall. 3. UNDERGROUND EASEMENT The applicant shall provide evidence of recordation of easements shown on Sheet C-1 prior to building permit issuance. 4. ANTENNA CONFIGURATION Only the Phase 3- panel antenna configuration is part of this ASA approval. The Phase 1 and 2 omni-directional antenna configurations are not approved.
