Reso 4742 2-Z-83 CITY OF CUPERTINO 10300 Tone Avenue Cupertino, California 95014 RESOLUTION NO. 4742 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL TO AMEND A PLANNED DEVELOPMENT ZONE FOR CITY CENTER TO ALLOW CONSTRUCTION OF 141,000 SQ. FT. OFFICE BUILDING PLUS 4 LEVELS OF UNDERGROUND PARKING FOR SYMANTEC CORPORATION ON 1.29 ACRES SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a change of zone, as described on this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and WHEREAS, the Planning Commission finds that the subject change of zone meets the following requirements: a) That the change of zone is in conformance with the General Plan of the City of Cupertino, and is consistent with the existing uses on the subject lots. b) That the property involved is adequate in size and shape to conform to the new zoning designation. c) That the new zone encourages the most appropriate use of land as compared to the majority of other parcels in this same district. d) That the proposed change of zone is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of subject parcels. e) That the change of zone promotes the orderly development of the city. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for change of zone is hereby recommended for approval; and That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application No. 2-Z-83 as set forth in the minutes of the Planning Commission Meeting of August 26, 1996, and are incorporated by reference as though fully set forth herein. Resolution No. 4742 2-Z-83 August 26, 1996 Page -2- SEGTION II: PROJECT DESCRIPTION Application No: 2-Z-83 Applicant: Symantec Property Owner: Cupertino City Center Apartment II, by Sunset Ridge Development Location: Lot 5 of Tract 7953 Cupertino City Center SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. SITE EXHIBITS The master zoning plan is modified allow the construction of a 141,000 square feet of 4-story office building at the southeast corner of DeAnza Boulevard and the eastern extension of Scofield Drive. The parcel located to the North of SYMANTEC site may be used for retail and/or residential subject to an approved use permit which allocates retail space and/or residential dwelling units permitted by the General Plan and Stevens Creek Boulevard Specific Plan. 2. PARKING The "Symantec Site" shall accommodate approximately 657 parking spaces to meet the need of the ! Symantec Building and shared parking spaces to meet the need of surrounding land use activities that have right of use for parking based upon written parking agreements. The number of parking spaces ' shall also be increased to accommodate parking spaces last on the adjoining property to the south as a result of "off site" landscaping. The below grade parking garage may be expanded to accommodate the additional parking spaces. 3. CORNER PARK The owners of the Park located adjacent to the intersection of DeAnza Boulevard and Stevens Creek Boulevard and the applicant for the Symantec Building and the City shall participate in the planning and installation of improvements for said park (Lot 8, Tract 7953). The degree of participation for each party shall be based upon benefit formula to be approved by the City Council. One element of � the formula is the degree of commitment by private owners to install improvements as manifested by previously approved drawings. 4. STEVENS CREEK BOULEVARD STREETSCAPE The applicant shall participate in the cost of installation of the Stevens Creek Boulevard Specific ' Plan streetscape improvement for the portion of Stevens Creek Boulevard fronting the "City Center Hotel Site" (APN 369-01-029). The degree of financial participation shall be based upon a formula to be approved by the City Council. The formula and necessary agreements for improvements shall be approved and executed prior to issuance of a building permit for a Symantec Site. i Resolution No. 4742 2-Z-83 (Mod.)
