Reso 4738 3-GPA-96 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4738 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE ADOPTION OF AN AMENDMENT TO REVISE THE LAND USE MAP DESIGNATION ON (APN#326-15-010) FROM MED-HIGH DENSITY RESIDENTIAL 10-20 DWELLING UNITS PER GROSS ACRE TO LOW DENSITY RESIDENTIAL 1-5 DWELLING UNITS PER GROSS ACRE , SECTION I: FINDINGS WHEREAS, the City of Cupertino initiated an application for General Plan Amendment as described in Exhibits and; WHEREAS, the necessary public notices have been given in accordance with the Procedural � Ordinance of the City of Cupertino; and the Planning Commission has held at least one hearing on the matter; and WHEREAS, the Planning Commission considered the potential environmental impacts of the project and found they were not significant. WHEREAS, the Planning Commission considered the characteristics of a development with three dwelling units and that density range is not in character with the primarily single family neighborhood. These characteristics include setbacks, lack of useable rear yard area, extraordinary tree removal and high floor area ratios. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for General Plan Amendment, Application No. 3-GPA-96, revising the text of the General Plan, is hereby recommended for approval as shown in legal description and plat map. That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 3-GPA-96 as set forth in the Minutes of the Planning Commission Meeting of August 14, 1996, and are incorporated by reference as though fully set forth herein.
