RESOLUTION NO. 4724
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING
DENIAL OF A TENTATIVE MAP TO SUBDIVIDE A 10,165 SQ. FT. PARCEL INTO THREE
APPROXIMATELY 1,800 TO 2,200 SQ. FT. PARCELS AND A CONDITIONAL USE PERMIT TO
CONSTRUCT 3 SINGLE FAMILY RESIDENCES ON A 10,165 SQ. FT. LOT IN A PROPOSED
PLANNED DEVELOPMENT RESIDENTIAL ZONE
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Tentative
Subdivision Map and Conditional Use Permit as described on Page 1 of this Resolution; and
WHEREAS, the necessary public notices have been given as required by the procedural ordinances of
the City of Cupertino, and the Planning Commission has held at least one Public Hearing in regard to
the applications; and
WHEREAS, the Planning Commission finds that the application as follows:
1. The characteristics of a development as designed using the existing density range is not in
character with the primarily single family neighborhood. These characteristics include
setbacks, lack of useable rear yard area, extraordinary tree removal and high floor area ratios.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for a Tentative Map and Conditional Use Permit is hereby recommended for
denial.
PASSED AND ADOPTED this 8th day of July, 1996, at a regular meeting of the Planning
Commission of the City of Cupertino, State of California, by the following roll call vote:
