CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4719 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO INTERPRETING CONDITION #4 OF PLANNING COMMISSION RESOLUTION NO. 4667 RELATING TO PROPOSED ROOFING MATERIALS ' FOR THE CUPERTINO VILLAGE SHOPPING CENTER AT THE SOUTHWEST CORNER OF HOMESTEAD AND WOLFE ROADS i SECTION I: PROJECT DESCRIPTION Application No.: Interpretation of 9-ASA-95 (Mod.) Applicant: Peter Pau Property Owner: Cupertino Village Associates Location: Southwest corner of Homestead and Wolfe Roads �� SECTION II: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application requesting interpretation of condition #4 of Planning Commission Resolution No. 4667 for application no. 9-ASA-95 (Mod.); relating to any new roofing material proposed for the Cupertino Village Shopping Center; and WHEREAS, the applicant has not demonstrated a compelling reason for finding an interpretation of condition #4 in favor of the applicant in that: � 1. the submitted composition shingle does not have a thickness or overlap similar in � appearance to the present heavy shake roof; and 2. That the thinness of the shingle even when overlapped does not present a substantial � enough appearance for the dominating roof to be appropriate for the design of the buildings. F NOW, THEREFORE, BE IT RESOLVED: � That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the Planning Commission finds that the submitted composition ; shingle does not meet the intent of condition #4 of Resolution No. 4667. That the subconclusions upon which the findings specified in this Resolution are based and contained in the public hearing record concerning an interpretation of Application Resolution No. 4719 Interpretation of 9-ASA-95 (Mod.) June 24, 1996 Page -2- 9-ASA-95 (Mod.) as set forth in the Minutes of the Planning Commission Meeting of June 24, 1996, and are incorporated by reference herein.
