Reso 4712 9-ASA-96 CITY OF CUPERTINO 10300 TORRE AVENUE CUPERTINO, CALIFORNIA 95014 RESOLUTION NO. 4712 OF THE PLANNING COMMISSION AND CITY OF CUPERTINO APPROVING A SIGN EXCEPTION TO APPROVE A SIGN PROGRAM FOR THE CENTURY AUTO PLAZA LOCATED AT THE CORNER OF STEVENS CREEK BOULEVARD AND STELLING ROAD SECTION 1: PROJECT DESCRIPTION Application No.: 9-ASA-96 Applicant: Paul Weiss Property Owner: Paul Weiss Location: 20955 B Stevens Creek Boulevard SECTION II: FINDINGS h WHEREAS, the Planning Commission of the City of Cupertino received an application for a sign exception as described in this Resolution; and WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and has met the following findings for a Sign Exception as required in Section 17.44.040 of the Cupertino Municipal Code: 1. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent with the spirit and intent of this ordinance; 2. That the granting of the exception will not result in a condition which is materially detrimental to the public health, safety, or welfaze; and 3. That the exception to be granted is one that will require the least modification of the prescribed regulations and the minimum variance that will accomplish the purpose of merchandising automobiles. NOW, THEREFORE BE IT RESOLVED: That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the application for exception is hereby approved; and BE IT FURTHER RESOLVED: That this application is approved subject to the following conditions. Resolution No. 4712 9-ASA-96 June 10, 1996 Page -2- SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. Condition 1- Annroved Exhibits The Sign program is approved contingent upon the sign application program labeled application 9-ASA-96 - Paul Weiss - Century Auto Plaza Sign Program - Sheets 1-4. The wall sign labeled #2 is not approved. The 25 ft. high Chrysler/Plymouth sign is approved contingent upon the deletion of the 10 ft. high Chevrolet sign (Sign C) located on Stelling Road. Condition 2 - Promotional Signs Condition 2: The applicants may use promotional advertising devices currently in use on the property as depicted in site photographs attached made an exhibit to this application. The promotional signs must comply with "site angle" criteria for driveway exiting and site safety issues. Condition 3- Future Street Modification The applicant is made aware that any installation of signs based on this application which may need relocation at a future date due to the installation of a bike lane, will be at the owner's sole expense. � � Condition 4- Ann� �ranted for multiple auto dealershin The approval for additional signs is contingent upon continued use as a multiple auto dealership. If a single auto dealership is reestablished or if the site is used for an activity other than auto retailing, the new signs must be removed.
