OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AN
EXCEPTION TO EXCEED WALL SIGN HEIGHT AS REQUIRED IN CHAPTER 17.24.060
SECTION I: PROJECT DESCRIPTION

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a sign
exception as described in this Resolution; and
WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and has met
the following findings for a Sign Exception as required in Section 17.44.040 of the Cupertino Municipal
Code:
1. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsiste�t
with the spirit and intent of this ordinance;
2. That the granting of the exception will not result in a condition which is materially detrimental to the
public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of the prescribed
regulations and the ininimum variance that will accomplish the purpose.
NOW, THEREFORE BE IT RESOLVED:
That after careful consideration of maps, facts, e�ibits and other evidence submitted in this matter, the
application for exception is hereby approved; and
BE IT FURTHER RESOLVED:
That the subconclusions upon which the findings and conditions specified in this resolution are based are
contained in the public record concerning application 7-EXC-95, as set forth in the minutes of the
Planning Commission Meeting of January 8, 1996, and are incorporated by reference as though fully set
forth herein. .
