CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4631 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A USE PERMIT MODIFICATION TO EXPAND THE PARKING LOT AT AN EXISTING CHURCH SITE AT 20075 BOLLINGER ROAD SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described in Section II. of this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirements: 1) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2) The proposed use will be located and conducted in a manner in accord with the Cupertino Comprehensive General Plan and the purpose of this title. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Use Permit Modification is hereby approved subject to the conditions which are enumerated in this Resolution beginning on page # 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public heazing record concerning Application 3-U-66 (M) set forth in the Minutes of the Planning Commission Meeting of August 14, 1995, and are incorporated by reference though fully set forth herein. Applicant: Mr. Silas Yang Property Owner: The Stewards of the Church Assembly in Cupertino Location: 20075 Bollinger Avenue (approximately 490 feet westerly of Blaney Avenue) SECTION III• CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. l. APPROVED EXHIBITS The approval is based on the Site Plans (Exhibit A- Sheets 1 A, 1 B, 1 C and 2) of Application 3-U-66 (Mod.), except as may be amended by the Conditions contained in this resolution. 2. GR.ADING PLAN A grading and drainage plan shall be submitted to the Building Department and the Cupertino Sanitary District for approval. In addition, handicapped parking, building access and signage details shall be provided to the Building Department for approval prior to the issuance of a building permit. 3. SEATING ARRAN EMENT IN ASSEMBLY AREA A drawing showing the seating arrangement, with the seat and aisle widths marked, shall be submitted to the Santa Clara County Central Fire Protection District for certification of occupancy load in the assembly area in the church prior to issuance of building permit. 4. POSTING OF ROOM CAPACITY The capacity of the room shall be posted in a conspicuous place in the room or an approved sign near the main exit from the room. 5. APPROVED USE This use permit does not affect the conditions of approval by the Planning Commission Resolution No. 1217, approved on the 29th of October, 1973, granting a use permit to allow a pre-school learning center. It states "that the number of children be limited to twenty five during each session with Planning Commission approval needed to increase the enrollment".
