RESOLUTION No. 4618
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THAT THE CITY COUNCIL CERTIFY THAT THE
ENVIRONMENTAL IMPACT REPORT (STATE CLEARINGHOUSE NUMBER
93081132) FOR THE LANDS OF THE DIOCESE OF SAN JOSE GENERAL PLAN
AMENDMENT 1-GPA-93 IS COMPLETE AND 1N COMPLIANCE WITH THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.
WHEREAS, The Planning Commission has reviewed the Environmental Impact Report
(EIR) to consider the potential significant impacts that the Lands of the Diocese of San
Jose General Plan Amendment may have on the environment; and
WHEREAS, the Planning Commission has held public hearings and considered the
comments from citizens, and from representatives from other public agencies and other
interested groups on the EIR; and
WHEREAS, the Planning Commission has reviewed the responses to comments made at
the public hearings and the review period; and
WHEREAS, the Planning Commission exercised its independent judgment while
considering the information contained in the EIR prior to reaching a decision to approve
said General Plan Amendment; and
WHEREAS, the Planning Commission recognizes that the Final EIR contains changes to
comments made by the Commission and the public, but which do not constitute any new
significant environmental impact or mitigation measure nor reflect any substantial
increase in the severity of an environmental impact; and
WHEREAS, the Planning Commission recognizes that there may be differences between
or among the different sources of information and opinions offered in the documents,
testimony and comments that make up the Final EIR and the administrative record as a
whole. Experts and others can disagree, and this Commission bases its decisions and
these findings on its independent judgment of that substantial evidence in the record
which it finds most compelling; and

NOW, THEREFORE, the Planning Commission recommends that the City Council
certify the Environmental Impact Report to be adequate and complete and in compliance
with the California Environmental Quality Act and the CEQA Guidelines.
PASSED AND ADOPTED this 18th day of July, 1995, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the following roll
call vote:
