Reso 4612 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4612 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO MAKING A DETERMINATION OF FRONT SETBACKS IN ACCORDANCE WITH SECTION 19.08.030 OF THE MUNIC CODE ' SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino has received an application for a � determination, as described in Section II of this Resolution; and , WHEREAS, the applicant has met the burden of proof required to support the application, and has satisfied the following requirements: 1. That the relationships between buildings and parcels are made better through the interpretation made herein. This creates two side-yard setbacks between buildings instead of a side yaxd to a front yaxd � setback which would exist with the existing definitions. , 2. This interpretation locates the building farther from Stelling Road and the related roadway noise. � NOW, THEREFORE BE IT RESOLVED: ( That after careful consideration of maps, facts, exhibits and other evidence submitted in this matter, the � application for interpretation is hereby made; and � � BE IT FURTHER RESOLVED: i That the subconclusions upon which the findings and conditions specified in this resolution are based are contained in the public record concerning application 2-EXC-95, as set forth in the minutes of the ' Planning Commission meeting of June 12, 1995, and are incorporated by reference as though fully set ; forth herein. � �ECTION II: PROJECT DESCRIPTION � Applicant: Tom Hirano Property Owner: Tom Hirano Project Location: 10911 S. Stelling Road ► INTERPRETATION MADE BY THE PLANNING COMMISSION 1. LOT SETBACKS It is hereby decided that the Lot No. 4 east property line is the rear property line, the west property line is the front property line and the north and south property lines are the side property lines.
