Application No(s): 2 -U -93 Applicant: Imwalle /Stegner Property Owner: Homestead II Assoc. Location: 19998 Homestead Road USE PERMIT for a pizza establishment in an existing shopping center. Staff Presentation: Planning Director Cowan presented the staff report outlining the location of the pizza establishment. Regarding traffic, Mr. Cowan stated this establishment will generate approximately 3 -5 trips per 1000 sq. ft. and noted traffic is not a major issue. Regarding proximity to single family homes, Mr. Cowan stated this establishment is approximately 150 ft. away for any resident. Mr. Cowan stated, given the nature of the - business, staff is not concerned about the proposed establishment operating to 12 a.m. He noted staff recommends approval subject to the conditions contained in the staff report. In response to the Commissioners questions Ms. Bjurman stated no other business in this location operates until midnight. She outlined the surrounding businesses. In response to Com. Bautista's question, Mr. Cowan stated it is common to have service stations operate 24 hours as long as they are not adjacent to residential areas. Planner Bjurman noted there are no records of other buildings operating beyond midnight. The public hearing was opened. Mr. Rick Shaiper, representing the applicant, in response to Com. Doyle's concerns, noted the bar in the back building and the Quick Stop are opened until 2 a.m. He stated the establishment they are proposing is 996 sq. ft. and will be mainly take -out. He noted the applicant and architect accept the conditions as stated in the staff report. The public hearing was closed. In response to Com. Bautista's question, Mr. Cowan stated that all property owners within 300 ft. were notified. PLANNING COMMISSION MINUTES Regular Meeting of June 28, 1992 Page 3 MOTION: Com. Bautista moved to approve application 2 -U -93 subject to the findings and subconclusions of the hearing SECOND: Com. Doyle VOTE: Passed 3 -0 -2 ABSENT: Mahoney, Roberts 3. Application No(s): 1 -U -81 (Mod) Applicant: University of San Francisco Property Owner: Cupertino Office Park Assoc., LTD Location: 20085 Stevens Creek Blvd. USE PERMIT to occupy an existing office building to provide an adult education program. Staff Presentation: Planner Bjurman presented the staff report noting the request is to relocate, expand and occupy 10,000 s. f . of an existing 14,400 s.f. building with the remaining 4,400 being occupied by office use. Regarding parking, Ms. Bjurman stated there are 63 existing parking spaces and there is a need or requirement for 77 parking spaces with this particular use. She noted 120 students would come for a 6 p.m. class and the remaining office would vacate at 5 p.m. She noted staff recommends a parking - agreement with the adjoining property located to the west, also owned by the same property owner. She stated this would provide for adequate parking. Ms. Bjurman reviewed the vehicle trips generated, as outlined in the staff report. She noted although the trips generated are high they are split 50 -50 on Stevens Creek Blvd. She also noted that most of the students will come at the end of the peak hour. She stated a study determined that the nearby intersections and streets will not be significantly affected by the trips generated. Ms. Bjurman stated it is staff's position that the existing use provides a substantial need to the community and provides a significant social benefit. She noted classes will be held Monday through Thursday. Chr. Austin opened the public hearing. Applicant Presentation: Ms. Adele Salle, University of San Francisco, stated classes are four hour sessions and starting later than 6 p.m. would not be an alternative solution. She noted they would also like approval for Saturday classes. She added the University has been in Cupertino for 10 years and there have been no complaints. Ms. Salle also outlined the number of students attending classes at their existing site, noting that approximately 20% of the students live or work in Cupertino. Ms. Mary Ann Tavoner, representing property owner, outlined the existing occupants within this center. She noted she took eight separate parking counts and noted out of the 123 parking spaces in the adjoining building an average of 85 parking spaces were taken up and feels parking will not be an issue. Ms. Tavoner stated she PLANNING COMMISSION MINUTES Regular Meeting of June 28, 1992 Page 4 was over at the school and students do not arrive to class until close to 6 p.m. She spoke in favor of having the University as a tenant. The public hearing was closed. Com. Doyle stated parking is adequate. He questioned the Saturday classes? Planner Bjurman stated the existing model resolution does not specify Saturday operation and should be added if the Commission agree to this. She noted the existing use permit on Bollinger Road does allow Saturday operation with certain restrictions. Com. Doyle expressed concern about the trips generated. Planning Director Cowan stated staff felt this is a unique use and most of the trips will come at the end of the peak hour. He also noted this is a social benefit to the community. Com. Doyle stated adding these trips to the traffic model would increase the traffic load at intersections. Mr. Cowan stated if the Commission is concerned about the trips generated, they have the option of asking the applicant to start classes at 6:15 p.m. Com. Bautista stated he does feel the impact would be significant, but not as significant as the 120 trips stated in the staff report, because students will attend school as they leave work and 20% of the trips are coming from within Cupertino. He also noted some trips would be reduced from Bollinger. Mr. Cowan stated although the applicant is asking for approval for 120 students, they currently do not have this attendance. Com. Doyle expressed concern about the trips generated and noted this project is significantly higher than the current model usage for this property. In response to Com. Bautista's question regarding monitoring traffic at Stevens Creek Blvd. and Bollinger, Mr. Cowan stated the Congestion Management Agency require that the major arterials be assessed yearly. Chr. Austin stated she is not concerned about the trips generated because of the hours of operation. She does not feel the trips will have a significant impact. Com. Doyle expressed concern about setting a precedence and putting these extra trips into the model and degrading the levels of PLANNING COMMISSION MINUTES Regular Meeting of June 28, 1992 Page 5 service. He suggested 6:15 p.m. start for classes. Mr. Cowan stated the level of service criteria is based on the 5 -6 p.m. peak hour and 6:15 p.m. would take the trips out of the peak hour. In terms of the precedence, Mr. Cowan noted this is a unique situation and does not believe this would set a precedence. Com. Doyle stated if the Commission agrees with the trip analysis done in the past this will have a. negative impact and this is his concern. Com. Bautista requested that the applicant give some input as to the 6:15 p.m. class time. Ms. Salle stated starting at 6:15 p.m. would mean finishing at 10:15 p.m. and this is too late. She stated they do not want to delay beyond 6 p.m. start. MOTION: Com. Bautista moved to recommend approval of application 1 -U -81 (Mod.) subject to the findings and subconclusions of the hearing with an additional condition allowing Saturday operation up to 6 p.m. SECOND: Chr. Austin VOTE: Passed 2 -1 -2 NOES: Com. Doyle ABSENT: Mahoney, Roberts NEW BUSINESS: 4. Discussion of meeting schedule change for the month of August. The Commission agreed to continue this to the next meeting.
