Mahoney moved to approve the minutes of January 25, 1993, as presented. SECOND: Com. Roberts VOTE: Passed 5 -0 POSTPONEMENTS OR NEW AGENDA ITEMS: - None WRITTEN COMMUNICATIONS: - None ORAL COMMUNICATIONS: - None CONSENT CALENDAR: - None PUBLIC HEARINGS: - None NEW BUSINESS: 1. Consideration of a motion to set a hearing for rezoning of two parcels, APN 359 -18 -47 & 359- 18 -46, from the R3 to the R1 zoning district. Staff Presentation: Planning Director Cowan presented the staff report, outlining the property in question on a site plan map. He noted State law requires the City's zoning map to be consistent with the General Plan. He added the property surrounding the property in questioned is zoned R1. He stated there is no room in PLANNING COMMISSION MINUTES Regular Meeting of February 8, 1992 Page 2 the General Plan Map to allow the R3 to occur and staff recommends the Planning Commission initiate a hearing. In response to Com. Mahoney's question, Mr. Cowan stated the area was developed for single family homes. He stated the General Plan is designed to be flexible, with regards to the geographical boundaries. He added, if the owner wants to amalgamate his property with the property to the North to develop as one commercial site, this can be considered. In response to Com. Mahoney's question regarding other R3 properties in the area, Mr. Cowan noted eventually the entire zoning map will be reviewed. In response to Chr. Austin's question, Mr. Cowan stated mixed use would be part of a planned development. Com. Roberts stated if there was a change in use on the Commercial property, this may cause problems being up against residential. Com. Mahoney stated the new General Plan encourages mixed use development. MOTION: Com. Mahoney moved to initiate a rezoning on Santa Clara County Assessor Parcel numbers (359 -18 -46 and 359- 18 -47), to be consistent with the General Plan. SECOND: Com. Doyle VOTE: Passed 5 -0 2. Annual Report on the status of the Cupertino General Plan pursuant to Government Code Section 65400(b) Staff Presentation: City Planner Wordell presented the staff report dated February 8, 1993. She noted the implementation section will have priorities, and each year it will serve as a performance based method for evaluating the progress. Ms. Wordell outlined potential areas for growth on a map. Ms. Wordell addressed the housing. She noted the City is not reaching the goal for the construction of housing in the existing general plan. She stated ABAG does require the City to provide its fair share of housing. She added the existing General Plan had a shortfall, but the new General Plan, as proposed, does identify the sites required by ABAG. Relating to non - residential, there was very little growth. Ms. Wordell noted according to the existing General Plan, the City is 78% built out. She noted when the new General Plan is adopted, more growth will be allowed above the General Plan if certain conditions are met. She stated one of the most significant achievements of 1992 was the work on the Housing Mitigation Program. She stated the proposal PLANNING COMMISSION MINUTES Regular Meeting of February 8, 1992 Page 3 will be considered in the General Plan and could result in changes in the future. Ms. Wordell reviewed the objectives and progress housing programs, as outlined in the staff report,in 1992 for the City Planner Wordell also reviewed the Legal Adequacy, the current proposal for housing should be acceptable to the State. She added this is a report and requires no action from the Planning Commission. Planning Director Cowan stated 25 -30% of the Cities in the State have a housing element which is in compliance with the State. Ms. Wordell noted the State wants the also wants a commitment to the program. C1 She added he City and have programs in place. Mr. Cowan noted, although second units are allowed, they have had no applications. He noted that second units must have a kitchen and should be a separate and distinct unit. MOTION: Com. Bautista moved to send a Minute Order to Council recommending acceptance of the report. SECOND: Com. Mahoney VOTE: Passed 5 - 0 REPORT OF THE PLANNING COMMISSION: Com. Austin questioned Article 34, as referenced under Housing in the General Plan report attached to the Planning Director's report? Planning Director Cowan stated Article 34 is part of the Constitution and requires a vote from the people. REPORT OF DIRECTOR OF COMMUNITY DEVELOPMENT: Planning Director Cowan stated he would like to schedule a workshop with the Commissioners. He noted he will invite Bert Viskovich to the meeting to explain the Congestion Management Program. He noted other technical matters will be discussed. There was a consensus of the Commission to have a workshop at the next regular meeting. DISCUSSION OF NEWSPAPER CLIPPINGS: In response to Com. Bautista's question, regarding combining ASAC and the Planning Commission, Mr. Cowan stated this was discussed at Council level and there may be a move to combine both, but has no more information at this time. He noted ASAC is presently working on a sign ordinance and if the changes are dramatic, there may be no need for the Committee.
