Reso 4574 81,156 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 (Minute Order) RESOLUTION NO. 4574 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF AN ORDINANCE AMENDING CHAPTER 19.40, RESIDENTIAL HILLSIDE ZONES, OF THE CUPERTINO MUNICIPAL CODE SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino requested the amendment to Chapter 19.40 of the Cupertino Municipal Code, as described on this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and WHEREAS, the Planning Commission finds that the subject municipal code amendments are consistent with the spirit and intent of the Residential Hillside Zones Code; and NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for amending the Cupertino Municipal Code is hereby recommended for approval; That Chapter 19.40 to be amended to read as follows: 19.40.030 Permitted Uses: G. The keeping of animals as follows: 1. Household pets limited to one animal per 3,000 sq./ft of lot area exT a. Adult dogs are limited to a maximum of two for lots less than 1 acre and four for lots greater than one acre. b. The number of geese, ducks�chickens, rabbits, and other farm animals are not reauired on a site greater than 1 acre. 2 . A��.�4 ����. n o �imi4n� 4� � rv�nvimum .���..i+ , 3. Small household pets 4. Large animals, such as horses, cows, sheep, and goats, limited as follows: a. Two 9�e large animal for the first 40,000 square feet of land area, except mules and donkeys which require 80,000 square feet for the first animal. b. One additional large animal for each 20,000 square feet of land area. c. One additional large animal if said animal is raised for a 4H project or profit sponsored by recognized agricultural organization or a school project. S. The required lot area for a large animal shall not be included in the required lot area for a household pet or vice versa, except that a maximum of two (2) household pets may be kept with large animals. 1 Resolution No. 4574 November 14, 1994 Page -2- 6. All animals must be kept and maintained in accordance with other Cupertino or Santa Clara County codes and ordinances. 7. No animals kept and maintained in an RHS zoning district may be raised for commercial purposes. 8. Cro�, tree or horticultural farming for personal use. Site Grading: � 1) All site grading shall be limited to 2500 cubic yards. The 2500 cubic yards includes building pad, yard areas, driveway and all other areas requiring grading. The graded area shall be limited to the building pad area to the greatest extent possible. A maximum of 2.000 �99A sq. ft. of flat yard area, excludin,g driveways, may be graded.
