RESOLUTION NO. 4564
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO INSTALL A NATURAL GAS VEHICLE FUELING
STATION FOR BOTH PUBLIC AND PRIVATE USE
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit,
as described on Page 1 of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
WHEREAS, the Planning Commission finds that the application meets the following requirements:
a) That the residential use is in conformance with the General Plan of the City of Cupertino, and is not
detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and above that of the capacity of the
existing street system.
d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general
welfare of persons residing or working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, e�chibits, testimony and other evidence submitted in this
matter, the application for Use Permit is hereby recommended for approval, subject to the conditions
which are enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this Resolution are based
and contained in the Public Hearing record concerning Application 5-U-94 as set forth in the Minutes of
the Planning Commission Meeting of October 10, 1994, and are incorporated by reference though fully
set forth herein.

SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.
1. APPROVED EXHIBITS
� The recommendation of approval for the installation of a natural gas vehicle fueling station based
� upon the Site plan, Section & Details plan and Improvements plan dated August 25, 1994, except as
� may be amended by the conditions contained herein.
2. APPROVED USE
A 24-hour natural gas refueling station is approved, as described in the Project Description dated
August 1994, except that only two tube trailers may be allowed to use the site during a 24-hour time.
� The natural gas storage tank shall be painted gray, shade to be determined by City staf£ The tube
� trailers may enter the site Monday through Friday, 8:00 A.M. - 8:00 P.M. weekdays and 9:00 A.M. -

8:00 P.M. on weekends (Saturday and Sunday).
3. TRUCKING ROADWAYS
The tube trailers are not approved to use Blaney Avenue as a truck route.

4. HANDICAP ACCESS
► The applicant shall implement the State of California handicap requirements for access and use.

5. CURBING
� The curb shall be continued from the west customer payment area, south and around the customer
�
� refueling area. This is to prevent vehicles from parking on or moving over the unpaved, gravel area.
► 6. LANDSCAPING
� The applicant shall submit and landscape and irrigation plan, drawn by a licensed landscape architect
and consistent with the Xeriscape Ordinance for the area between the customer fueling tank and the
� west side of the Operations Building. Particular attention should be given to obscuring views of the
compressor and other machinery in the P.G. & E. yard, behind the fence. The landscaping material
type shall be consistent with the existing landscaping.

� 7. LIGHTING

The applicant shall submit at the building permit stage the lighting details including: light standard,
� consistent with existing standards, light intensity, type of light and demonstrate that the light source
will not be visible off site.
8. BAY AREA AIR OUALITY MANAGEMENT DISTRICT
The applicant shall obtain and provide proof of a permit from the Bay Area Air Quality Management
District.

9. PUBLIC UTILITIES
The applicant shall provide clearance letters from the utility companies which currently hold
easements over the area of proposed improvement.
