OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING DENIAL OF
AN APPEAL TO A DIRECTOR' S APPROVAL OF A SMALL RECYCLING COLLECTION FACILITY
� IN ACCORDANCE WITH ORDINANCE NO. 1426
SECTION L• FINDINGS:
i
WHEREAS, the Planning Commission of the City of Cupertino received an appeal to a Director's
( Decision, as described in Page 1 of this Resolution; and
� WHEREAS, the necessary public notices have been given in accordance with the Appeal Ordinance of the
City of Cupertino, and the Planning Commission has held at least one Public Hearing on this matter; and
WHEREAS, the applicant meets the standards set forth in Ordinance No. 1426;
NOW, THEREFORE BE IT RESOLVED:
� That after careful consideration of maps, facts, testimony, e�ibits and other evidence submitted in this
matter, the appeal of a Director's decision is hereby recommended for Denial by the Planning Commission
of the City of Cupertino; and

( BE IT FURTHER RESOLVED:
That the subconclusions upon which the fmdings specified in this Resolution are based are contained in the
� Public Record concerning this appeal, as set forth in the Minutes of the Planning Commission Meeting of
� July 11, 1994, and are incorporated by reference as though fully set forth herein.

� 1. APPROVED EXHIBITS
� The recommendation of approval is based on the exhibit titled "Goodwill Donation Site."

� 2. The mobile facility is approved far the location perpendicular to the rear portion of the existing
I building, as shown on the attached plan.
3. The employee must park on an impervious surface, the Bateh Brothers parking lot.
4. The recycling facility must be set back ten (10) feet from the street line.
5. All provisions of Ordinance No. 1426, Section 6.2 (Small Collection Facility) must be adhered to.

6. If a change of use occurs on these parcels, a new permit by Goodwill Industries must be applied for
` and approved.
7. The area beneath the trailer and at least one parking space for patrons shall be sealed to prevent dust.
( 8. The length of the trailer shall be limited to 27 feet.
