RESOLUTION NO. 4531
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF AN ORDINANCE AMENDING CHAPTER 19.40, RESIDENTIAL
HILLSIDE ZONES, OF THE CUPERTINO MUNICIPAL CODE
SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino requested the amendment to Chapter 19.40 of the
Cupertino Municipal Code, as described on this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of
Cupertino, and the Planning Commission has held one or more public hearings on the subject application; and
WHEREAS, the Planning Commission finds that the subject municipal code amendments are consistent with the
spirit and intent of the Residential Hillside Zones Code; and
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, e�ibits, testimony and other evidence submitted in this matter, the
application for amending the Cupertino Municipal Code is hereby recommended for approval;
That Chapter 19.40 to be amended to read as follows:
19.40.050 Site Development Regulations:

C. Lot Area

1. The minimum lot area for a specific property shall correspond to the number (multiplied by one thousand
� square feet) following the RHS zoning symbol. Examples are as follows:

In addition, for lots which do not have a lot size number, the minimum lot area for a specific property shall be
determined through the subdivision process in terms of ineeting the policies of the Land Use Element of the
General Plan.

G. Site Grading:
1) All site grading shall be limited to 2500 cubic yards. The 2500 cubic yards includes building pad, yard
areas, driveway and all other areas requiring grading. The graded area shall be limited to the building
pad area to the greatest extent possible. A maximum of 2,000 sq. ft. of flat yard area, excluding
driveways, may be graded. All cut and fill areas shall be rounded to follow the natural contours and
planted with landscaping which meets the requirements in Section 19.40.050 (H).
19.40.060 Building Coverage, Setbacks, and Height Restrictions:
A. Delete this section.
B. Floor Area Ratio. The allowable floor area ratio is based on the net lot area and average slope of the
lot. As shown in Table 1, the floor area ratio ranges from a maximum of 45% to a minimum of 1 S% of the net
lot area un to a maximum o�ve thousand sc�uare feet.. Should the lot have an average slope greater than 10%,
a percentage of the net lot area shall be reduced by the indicated amount i� the slope adjustment chart prior to
calculating theallowable floor area ratio.

D. Setbacks - Second Floor:
1) Front/Rear:
a) Downhill elevation: At least 75% of the second story downhill facing wall plane shall be set back at
� least 10 feet from the first story downhill wall plane. The remaining 25% may not extend past the
first story wall plane.
THEREFORE, BE IT FURTHER RESOLVED:
That the subconclusions upon which the findings specified in this Resolution are based and contained in the Public
Hearing record concerning Application 81,156 as set forth in the Minutes of the Planning Commission Meetings of
June 13, 1994, and are incorporated by reference as though fully set forth herein.
