Reso 4525 i 1-GPA-94 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4525 ► OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING AMENDMENTS TO THE DRAFT HOUSING ELEMENT OF THE CITY OF CUPERTINO GENERAL PLAN SECTION I: FINDINGS: WHEREAS, the Planning Commission held a public hearing and considered public testimony regarding amendments to the Housing Element; � WHEREAS, the Planning Commission reviewed the State Department of Housing and Community Development's comments in a letter dated November 24, 1993 and has adequately addressed all of their comments to comply with Government Code 65580 et seq.; WHEREAS, the Planning Commission made the following fmdings that the Cupertino Housing Element substantially complies with the requirements established pursuant to Section 65350 et seq. of the Government Code which specifies the content of the Housing Elements; 1. The State identified a short-fall of 260 adequate housing sites. The amendments identify 680 additional sites to more than compensate for the short-fall, as shown in Appendix B. New sites are added, greater potential of existing sites is acknowledged and second units are counted. � 2. The State requested that there be additional program actions to increase the development F potential of the neighborhood sites in Appendix B. The amendments include a new strategy to allow flexible residential development standards and a new policy and program to promote development by providing property owners information about the development process. 3. The State requested that the specific plan potential be promoted by providing deadlines and information about the type and affordability of proposed units. The amendments provide deadlines. Potential development of proposed units is promoted by incorporating the planning district units shown in Appendix C into the specific plans. Type and affordability are described by estimating densities and defming the number of affordable units resulting from the housing mitigation program. 4. The State requested that incentives and programs be provided to encourage development of � higher density/mixed use housing and that there be specific commitments to land use/zoning changes to allow development to proceed in areas defined in program 3(Bandley Drive, Bubb i Road and portions of Stevens Creek Boulevard). There are many existing incentives, such as density bonuses, priority processing and development at the upper limit of the dwelling unit � intensity range. Additional sites are proposed in addition to the Bubb Road sites, and sites in the remaining areas are part of the specific plans. Amendments in the form of margin notes will emphasize the commitment to providing sites for approximately 1,500 housing units in the core area. RESOLUTION NO. 4525 1-GPA-94 May 23, 1994 Page -2- 5. The State requested more specific program actions and commitment to implement certain programs. Program 5 is amended to provide criteria for considering residential uses in specified areas and to provide a completion date. Program 12 is amended to provide specific actions which will be taken related to construction of rental housing. Proogram 18 is expanded to clarify the procedure for converting existing market rate to affordable rental units. Program 19 is arnended to provide specific program actions related to church, service organizations and schools districts participation in affordable housing policy. Program 23 is amended to provide more specific actions regarding technical assistance for financing strategies. WHEREAS, the Planning Commission fmds that are no significant environmental impacts from the amendments; NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission hereby approves the draft General Plan amendments to the Housing Element dated May 23, 1994 (amended); and 2. That the Planning Commission forwards the draft amendments to the City Council for adoption.
