CITY OF CUPERTINO � 10300 Tone Avenue Cupertino, California 95014 RESOLUTION NO. 4513 � OF THE PLANNING COMMISSION OF TI� CITY OF CUPERTINO RECOMMENDING APPROVAL OF A USE PERMIT FOR A PLANNED DETACHED SINGLE-FAMILY DEVELOPMENT CONSISTING OF 24 HOMES --------------------------------------------------------------------------- --------------------------------------------------------------------------- SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described on Page 1 of this Resolution; and WHEREAS, the applicant has met the burden of proof required to support said application; and I WHEREAS, the Planning Commission finds that the application meets the following requirements: a) That the residential use is in conformance with the General Plan of the City of Cupertino, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the property involved is adequate in size and shape to accommodate the proposed use. c) That the proposed use will not generate a level of traffic over and above that of the capacity of the existing street system. � d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general ► welfare of persons residing or working in the neighborhood of such proposed uses, nor injurious to property and improvements in the neighborhood. 1 NOW, THEREFORE, BE IT RESOLVED: T'hat after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Use Pernut is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and i That the subconclusions upon which the findings and conditions specified in this Resolution are based and contained in the Public Hearing record concerning Application 2-U-94 as set forth in the Minutes of the Planning Commission Meeting of March 14, 1994, and are incorporated by reference though fully set forth herein. APPROVED EXHIBITS i The recommendation of approval is based on the site development plan set dated February 18, 1994, labeled sheets A 1 through A7. The conceptual landscape plan dated February 17, 1994, labeled L 1 �` through L4, site sections dated March 9, 1994, lighting details, and Monta Vista color scheme dated March 7, 1994, except as may be amended by the conditions contained herein. ` 2. SITE LAYOUT FOR UNIT 24 Unit 24 shall be moved northerly so that the north side yard setback is at least 15 feet from the southerly edge � of the adjacent parking bay. 3. TREE PROTECTION The 4 specimen oak trees shall be protected during all construction activities pursuant to the requirements of the Heritage and Specimen Trees Ordinance conta.ined in Chapter 14.18 of the � Cupertino Municipal Code. 4. AFFORDABLE LJNITS 1 � Two of the 24 units shall be made affordable to median and moderate income families. The developer shall enter into an agreement with the City and the units shall be deed restricted for a period of 30 years pursuant to the requirements contained in the Housing Mitigation Manual. 1 5. PARKING RESTRICTIONS � Signs shall be posted along all streets within the project stating that parking is restricted to marked spaces only. / ` 6. FIRE SPRINKLERS Houses on lots 9, 10, 15, 16, 21 and 22 shall be equipped with an approved fire sprinkler system subject to the approval of the Central Fire Protection District. 1 � 7. Staff shall work with the developer and the adjoining property owners on Oakleaf Place to develop a tree screening plan. The trees shall be oak or native evergreen species.
