RESOLUTION NO. 4501
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A
SIGN EXCEPTION IN ACCORDANCE WITH CHAPTER 17.44 OF THE MUNICIPAL CODE
SECTION I: PROJECT DESCRIPTION
A�nlication 1-ASA-94 - Desi�n Mark: Sign exception from tenant name heights on ground signs as
required in section 17.24.130 of the Cupertino Municipal Code.
SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a sign
exception, as described in this Resolution; and
WHEREAS, the applicant has demonstrated a compelling reason for granting an exception and has met
the following findings for a sign exception as required in Section 17.44.040 of the Cupertino Municipal
Code:
� A. That the literal enforcement of the provisions of this ordinance will result in restrictions inconsistent
with the spirit and intent of this ordinance;
B. That the granting of the exception will not result in a condition which is materially detrimental to the
public health, safety, or welfare; and
C. That the exception to be granted is one that will require the least modification of the prescribed
regulations and the minimum variance that will accomplish the purpose.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, e�ibits, testimony and other evidence submitted in this
matter, the request for a sign exception is hereby approved; and
That the subconclusions upon which the findings specified in this Resolution are based and contained in
the Public Hearing record concerning Application 1-ASA-94 as set forth in the Minutes of the Planning
Commission Meeting of February 14, 1994, and are incorporated by reference herein.

DEPARTMENT.

The approval is based on the sign criteria e�ibit dated January 5, 1994, of application 1-ASA-94, except
as may be amended by the Conditions contained in this Resolution.
Colors
The applicant shall modify the background and/or foreground colors in order to create a greater contrast
between the two. The final colors shall be subject to staff approval.
