Reso 4496 CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4496 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING A PUBLIC HEARING BE SET FOR A GENERAL PLAN AMENDMENT TO CHANGE THE DESIGNATION OF APN 326-19-117 FROM COMMERCIAL/RESIDENTIAL TO RESIDENTIAL SECTION I: FINDINGS The Planning Commission of the City of Cupertino does hereby make the following finding for the above referenced General Plan amendment request: A. For determining a public hearing shall be scheduled: 1. The General Plan amendment is primarily based upon the degree to which the amendment will benefit the community and is compatible with the existing General Plan policies and goals. 2. The amendment appears to support the existing General Plan goals and objectives. (The degree of benefit can not be fully ascertained until the project is assessed environmentally, economically, and socially in the context of a public hearing for the amendment.) 3. The proposed amendment represents an unforeseen land use trend that has not been considered. 4. The existing General Plan policy which precluded the proposed land use activity is based on outdated or inaccurate information. B. For determining the amendment is major: 1. The proposed amendment meets the following definition for being considered a major amendment: 2. The amendment will result in social impacts which extend well beyond the project site. C. For scheduling the public hearing out of the normal General Plan amendment sequence: l. A long delay in scheduling a General plan amendment hearing will result in extraordinary hardships for an applicant and that an expeditious General Plan review will benefit the community.
